EASEMENT FOR STORM SEWER
THIS INSTRUMENT, Made this lst day of October 19 73,
by and between
W. J. Burke and Joan S. Burke, husband and wife
of the County of Hennepin
and State of Minnesota, parties of the first part, and the village
of Edina, a municipal corporation organized under the laws of the
State of Minnesota, party of the second part;
WITNESSETH, that the said parties of the first part, in
consideration of One and No /100 (1.00) Dollars, to them in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do Grant, Bargain, Sell, Convey, and Warrant
to said party of the second part an Easement in perpetuity for
storm sewer purposes, including the right to enter for the purpose
of constructing, maintaining, altering, repairing and reconstruct-
ing a storm sewer system in, under, and over the following describ-
ed property situate in the County of Hennepin and State of
Minnesota, to -wit:
That part of Outlot 1, Schey's Park View lying Westerly of the
\ following described line:
Beginning at a point on the South line of said Outlot 1, which
point is 20 feet East of the Southwest corner of said Outlot 1;
thence Northwesterly to a point 55 feet North of the South line
and 10 feet East of the West line of said 0utlot 1; thence
Northerly 10 feet East of and parallel with the West line of
said Outlot 1, a distance of 75 feet; thence Northeasterly a
distance of 35 feet to a point 6 feet Southeasterly, as measured
at right angles, from the Northwesterly line of said Outlot 1;
thence Northeasterly to a point on the North line of said Outlot
1, which point is 12 feet Easterly of the Northwest corner of ll

This instrument is exempt from the State Deed Tax.

It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said storm sewer replace any shrubs or sod removed
by any excavation in connection with such construction or mainten-
ance work, in as nearly as possible the same condition as before
such excavation. This instrument was drafted by

have hereunto set their hands and seals the day and year first
