EASEMENT FOR RETAINING WALL AND BACK SLOPE PURPOSES
THIS INSTRUMENT, made and entered into this 41 ay of
a
Jt,t)t = 1975, by and between Minneapolis, Northfield and
Southern kailway, a South Dakota corporation, hereinafter referred
to as "MN & S," and City of Edina, a municipal corporation
organized under the laws of the State of Minnesota, hereinafter
referred to as "Edina."
WHEREAS MN & S desires to grant a perpetual easement to
Edina, and Edina desires to accept such easement,.subject to the
terms and provisions hereof.
NOW, THEREFORE, in consideration of the terms and provisions hereof,
the parties hereto agree as follows:
1. MN & S hereby Grants, Bargains, Sells, Quit Claims
and Conveys to Edina an easement in perpetuity for constructing
and maintaining a retaining wall and back slope on the following
described property ( "Subject Property ") situate in the County of
Hennepin and State of Minnesota, to wit:
The West seven feet (7') of Lots 20, 21, and 22,
Block 2, Grand View Heights.
This instrument is exempt from the State Deed Tax.
