LONG, PARTIES OF THE SECOND PART The parties to the Contract for Deed to which this Exhibit A is attached do hereby further agree as follows: 1. This Contract for Deed and the Limited Warranty Deed to be given pursuant hereto are hereby expressly made subject to a reservation by party of the first part, for itself and its successors and assigns, of a perpetual easement for public sanitary sewer purposes, including the right to enter upon said easement for the purpose of constructing, maintaining, altering, repairing, and reconstructing a sanitary sewer system in, over, under, and across a strip of land (the "Easement Area ") 20 feet in width, the centerline of which is described as follows: Beginning at a point on the East line of said Lot 8, Block 2, Xerxes Avenue Addition, which point is 48 ,yam feet South of the Northeast corner of said Lot 8 when measured along said East lire; thence Westerly to a point on the West line of said Lot 8, which point is 51.5 feet South of the Northwest corner of said Lo_t OP' when measured along said West line; and there tgrininating. Said easement reservation shall also contain the. ollowing provisions: (a) Provided, however, that party of the first part, its suc- cessors and assigns, shall not disturb the surface of or enter upon that part of the Easement Area lying between a point 57.5 feet East of the West line of said Lot 8, to a point 122.5 feet East of the West line of said Lot 8, when measured along the centerline of the Easement Area, it being understood and agreed that a building presently exists, and may maintained and recon- structed, upon that part of the Easement Area lying between the two points above described, and that party of the first part shall have underground access only to the Easement Area between said two points. (b) Party of the first part, its successors and assigns, in doing any construction, maintenance, alteration, repair, or reconstruction 00- work in the Easement Area, shall replace any shrubs or sod that are removed in connection with any such work, to as nearly as possible the same condition as before such work was done. (c) Party of the first part, its successors and assigns, shall have no responsibility or liability of any kind whatsoever to either or both of the parties of the second part, or their respective heirs, representatives, successors and assigns, for any damage or injury to the present or any future building located on said Lot 8 due to or arising out of the existence of said easement hereby reserved, or due to or arising out of the exercise by party of the first part, its successors and assigns, of any of the rights and priv- ileges hereby reserved and granted as to said Easement Area, and parties of the second part, for themselves and their respective heirs, successors, represen- tatives, and assigns, hereby waive and release any and all such claims that they may now or hereafter have or claim to have against party of the first part, its successors.or assigns. G 2. Parties of the second part also own property at 357 Apple Lane, Minneapolis, Minnesota. Parties of the second part agree to use all due diligence and their best efforts to sell said property as soon as possible. Upon a sale thereof, and a closing of such sale, all proceeds thereof, up to the amount necessary to pay this Contract for Deed in full, with all accrued interest, shall be paid to party of the first part. If such payment does not pay this Contract for Deed, with interest, in full, such payment shall be applied first to interest then due, and the balance to principal. 3. Dear Bob: Don Lofthus called me on October 17 concerning the location of a garage on Lot 8, Block 2, Xerxes Avenue Addition. He wanted to relocate the garage so as to take advantage of the alley along the westerly 20 feet of the lots fronting on Xerxes Avenue and south of West 64th Street. I advised Don that I was unaware of any easement over the westerly 20 feet of our property and of the properties to the north giving access to West 64th Street. Subsequently, on October 21, 1974, we checked the ownership records of the lots along West 64th Street north of Lot 8 and were able to find only one document (Document No. 546603, dated December 4, 1957 and filed December 6, 1957 in the office of the Registrar of Titles, Hennepin County, Minnesota) that created an easement for driveway purposes over Lots 1, 2, 3, 4, and 5 of said Block 2. Therefore, the Lot 8 that the City now owns has no right to use the alley easement that exists over the westerly 20 feet of the lots to the north of it. Therefore, in relocating the garage on Lot 8, if it is to be situated to take advantage of the alley access, it should also be situated so as to be able to be used, if that access is not available, via a driveway access directly to Xerxes Avenue South. As I promised, I have now reviewed the files pertaining to this property. I find that the southerly half of this building is zoned "0 -1, Office ". I believe that you use this portion of the building for your professional office. The north half of the building is zoned "R -2, Two Family Dwelling Residential ". According to our zoning ordinance, the north half of the building could not be used for offices unless it, too, was rezoned to 0 -1. Such a rezoning requires action and approval by the Planning Commission and City Council. An application fee of $450 is required for such a rezoning. From a preliminary standpoint, I would personally not favor such a rezoning for the following reasons: 1) It could establish a precedent for the rezoning of other double bungalows fronting on Xerxes Avenue. 2) It could establish a precedent for converting double bungalows in other parts of the City to commercial uses. We have received many inquiries for this type of a conversion. 3) The present zoning of the subject property (i.e. south half 0 -1, north half R -2) represents a logical dividing line between com- mercial uses to the south and residential units to the north. 4) The use of the north half for office purposes would adversely affect the residence located northerly of the subject property and could prompt the owner to similarly petition for rezoning.
