THIS INDENTURE, made this day of /j C(f , 1977,
NEW ENGLAND MUTUAL LIFE INSURANCE COMPANY
a corporation under the laws of the State of
Massachusetts
, party of the
first part, and the CITY OF BLOOMINGTON, a municipal corporation under the laws of
the State of Minnesota, and the CITY OF EDINA, a municipal corporation under the
laws of the State of Minnesota, parties of the second part,
WITNESSETH, That said party of the first part, in consideration of the
sum of One and No /100 (1.00) Dollars and other valuable consideration to it in
hand paid by the said parties of the second part, the receipt whereof is hereby
acknowledged, does hereby Grant, Bargain, Quitclaim, and Convey unto the said
parties of the second part, their successors and assigns, Forever, all the tract
or parcel of land lying and being in the County of Hennepin and State of
Minnesota, described as follows, to wit:
An easement for floodage purposes over and across part of:
Lots 5 and 6, Block 1, NINE MILE WEST 2ND ADDITION
Said easement is described as lying south of a line described as follows: Begin-
ning at a point in the west line of said Lot 5, distant 60 feet north of the
southwest corner thereof; thence east to a point in the east line of said Lot 5,
distant 86.70 feet north of the southeast corner thereof; thence continuing east
to a point in the east line of said Lot 6, distant 118.61 feet north of the
southeast corner thereof, and there terminating.
TO HAVE AND TO HOLD THE SAME, Together with all the hereditaments and
appurtenances thereunto belonging or in anywise appertaining, to the said parties
of the second part, their successors and assigns, Forever.
IN TESTIMONY WHEREOF, the said first party has caused these presents to
