HomeMy WebLinkAbout194840 .s 4311604 CITY OF EDINA 4801 W. 50TH STREET EDINA, MINNESOTA 55424 NOTICE OF COMPLETION OF PROCEEDINGS ON STREET VACATION IN THE CITY OF EDINA HENNEPIN COUNTY, MINNESOTA NOTICE IS HEREBY GIVEN that the City Council of Edina, Hennepin County, Minne- sota, on July 11, 1977, adopted a resolution Va-ati ^.g Portion of Zenith Avenue after public hearing and notice thereof as required by law and after determining it to be in the best interest of the City and of the public that said street vacation be made, which resolution ordered the vacation of the following described portion of Zenith Avenue, all as platted and of record in the office of the Register of Deeds in and for Hennepin County, Minnesota: The West one -half of Zenith Avenue lying South of a line 153 feet South of and parallel to the central line of West 54th Street and Northerly of the Easterly extension of the Southerly line of Lot A, White Investment Company's Hidden Valley, Hennepin County, Minnesota. Ordi ante No. 105 (Envi onmental Quality Commission) is hereby repealed in its ent' ety and Ordinance No. 802 (Planning Commission) except Section 8 is hereb repealed, both affectiv on September 1, 1977. Mr. Dunn presented the petition for the vacation of a portion of Zenith Avenue South of id. 54th St., hearing for which street vacation had been ordered by Council resolution on June 6, 1977, and wiii.ch vacation was incorporated in the preliminary plat for James M. Wilson's First AddLtion, approved on June 20, 1977. No objections being heard, Councilman Shaw offered the fol.aowing resolution and moved ite, adoption: R1 SOLUTION VACATING PORTION 01' ZLc�i_.H[ AVLIIUE WIIEREAS, a resolution of the Gl.ty Council, adopted Lho. 6th clay of June, 1977, fixed a elate for the public hc.,,,.ir:Lng on a proposed vacation of a portion of Zenith 7WO/ 20(S Avenue; and WHEREAS, two weeks' published and posted notice of said hearing was given and the hearing was held on the 11th clay of July, 1977, at which time all persons desir- ing to be heard were given an opportunity to be heard thereon; and WHEREAS, the Council deems it to be in the best laterest of the City and of the public that said street vacation be made; and WHEREAS, the Council has considered the extent to which the vacation affects existing easements within the area of the vacation and the extent to which the vacation affects the authority of any person, corporation, or municipality owning or controlling electric or telephone poles and lines, gas and sewer lines, or water pipes, matins and hydrants on or under the area of the proposed vacation, to continue maintaining the same or to enter upon such street or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereto. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina, Hennepin County, Minnesota, that the following described portion of Zenith Avenue be and is hereby vacated effective as of July 11, 1977: The West one -half of Zenith Avenue lying South of a line 153 feet South of and parallel to the central line of West 54th Street and North- erly of the Easterly extension of the Southerly line of Lot A, White Investment Company's Hidden Valley, Hennepin County, Minnesota; And that the Clerk is authorized and directed to cause a notice of completion of proceedings to be prepared, entered in the transfer record of the County Auditor and failed with the Register of Deeds, in accordance with Minnesota Statutes, Section 412.851. Mr. Dunn called Council's attention to a letter which he had sent to property owners included in the area proposed to be assessed for Watermain Improvement No. WM -319B in which he had \1c ed in reviewing plans and the low bid submitted with the contractor, he had mined that, by reducing the area of street surfacing to be disturbed, the t of the bid can be reduced from $2,622.85 per connection to $1,915.89 pe d ion, the amount estimated at the March 21, 1977, hearing. Mr. Dunn recalled that at the time of the improvemelit.,hearing on gust 16, 1976, property owners had questioned whether they wanted c rbing on he East Frontage Road of T.H. 100 South of W. 70th Street. In accordan e wK the understanding made at the time of the hearing, Mr. Dunn had the road st< -d by the Highway Department and explained the situation to Mr. William L r 'son, 4920 Lantana Lane, who, in turn, contacted the nine affected property nlors determine if a property owners' meeting would be necessary.
