THIS INSTRUMENT, Made this 28thday of 19 77
by and between Paul A. and Mary E. Ryan, Husband and Wife
of the County of Hennepin and the State of Minnesota, parties of the first
part, and the City of Edina, a municipal corporation organized under the
laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said party of the first part, in consideration
of One and No /100 Dollars ($1.00), to it in hand paid by the said party of
the second part, the receipt whereof is hereby acknowledged, does Grant ,
Bargain, Sell, Convey, and Warrant to the said party of the second part
including the right to

enter for the purpose of constructing, maintaining, altering, repairing,
and reconstructing a watermain in, under, and over the following described
property situate in the County of Hennepin and the State of Minnesota, to -wit:
The East 5 feet of Lot 5, Block 1, Danijohn's Addition.
Together with a 10 foot wide temporary construction easement
lying Westerly of and abutting the above described permanent
easement. Said temporary easement shall terminate on December
31, 1977.

It is the intention and agreement of the Parties hereto that the party
of the'•secoind part shall in the construction, or maintenance of said
= watermain replace any shrubs or sod removed by any excavation in connection
with such construction or maintenance work, in as nearly as possible the
,same condition as before such excavation.
THIS DOCUMENT IS EXEMPT FROM DEED TAX
IN WITNESS WHEREOF, The said parties of the first part have hereunto

THIS INSTRUMENT,
