THIS IidSTRUMET;T, Made this 28thda7 of June IT 19- 77,
by and between Bertha Spafford a /k /a Bertha L. Spafford, Widow
of the County of Hennepin
and State of Minnesota, parties of the first part, and the City of
Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in
consideration of One and No /100 Dollars ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do Grant, Bargain, Sell, Convey and Warrant to
said party of the second part an Easement in perpetuity for utility
purposes, including the right to enter for the purpose of construct-
ing, maintaining, altering, repairing and reconstructing utility
systems in and over the following described property situate in the
County of Hennepin and State of Minnesota, to -wit:
That part of Lot 6 and the South one -half of Lot 5, Auditor's Subdivision
• No. 176 lying West of the East 175 feet thereof.

It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said utilities replace any shrubs or sod removed by
any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such
excavation.
This document is exempt from deed tax.

The TITLE INSURANCE COMPANY OF MINNESOTA does hereby certify:
That the property described in the Certificate of Title appears therein as follows:
The South half (S. 1/2) of Lot Five(5) and all of Lot Six(6), Auditor's Sub-
division One Hundred Seventy Six (176) Hennepin County, Minnesota,
according to the plat thereof on file or of record in the office of the
Register of Deeds in and for said Hennepin County.
That according to said Certificate, the property is registeied in the following names:
John H. Spafford and Bertha Spafford, his wife as joint tenants
who, according to said Certificate, are of the age Ebf 59&-53 years, respectively , are , married
to each other
,and a r e under no disability.
That recitals appear therein as follows:
Subject to an agreement that a strip of land 30 feet wide and running along
the Easterly side of and parallel with the right of way of the Minneapolis,
Northfield and Southern Railway, shall be opened, kept open, used and maintain
as a private street for the ingress and egress of the abutting owners who
shall pay the expenses for said opening and maintenance of that portion
of the said private street fronting on their respective properties.
Further that the said private street shall not be closed up, abandoned
or vacated except with the written consent of all of the then abutting owners
thereof, as contained in Doc.No. 218390, Files of Registrar of Titles
(See Exhibit A hereto attached)
