By In limitation of the foregoing, it is the intention and agreement of the parties hereto that in the event that the above described Easement interferes with the erection of any structure on any portion of the property described as Lots 7 and 8, Block 1, Lund Kruse Addition, and vacated Library Lane, all situate in the County of Hennepin and State of Minnesota, then, such Easement shall be abondoned and all utility systems in and over the de- scribed property shall, at the sale expense of the party of the second part be re- moved. In addition, it is the intention and agreement of the Parties hereto that the party of the second part shall in the construction, maintenance or removal of said utility systems replace any shrubs, sod, concrete sidewalk or bituminous paving removed by any excavation in connection with such construction maintenance or re- moval worb, in as nearly as possible the same condition as before such excavation. t Drafted by: Ift.
