HomeMy WebLinkAbout2047r y 4404647 EASEMENT FOR WATERMAIN THIS INSTRUMENT, Made this 21st day of July , 1978 , by and between WINFIELD DEVELOPMENTSjINC. a corporation under the laws of the State of Minnesota, party of the first part, and the City of Edina, a municipal corporation organized under the laws of the State of Minnesota, party of the second part; WITNESSETH; That the said party of the first part, in consideration of One and No /100 Dollars ($1.00), to it in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, does Grant, Bargain, Sell, Convey, and Warrant to said party of the second part an Easement in perpetuity for watermain purposes, including the right to enter for the purpose of constructing, maintaining, altering, repairing, and reconstructing a watermain in, under, and over the following described property situate in the County of Hennepin and State of Minnesota, to -wit: Utility Easement for Water and Sewer A strip of land 24' in width, the center line of which is described as follows: Commencing at a point on the north line of Lots 4, 5 and part of Lot 6, Block 8, Edina Interchange Add'n, said point being 195' east of the west line of said.Lot 4, thence southerly at right f angles to the said north line of said Lots 4, 5 and part of Lot 6, a distance of 308' and there terminating, together with a strip of land lying southeasterly of the following described line and westerly of the above described easement, commencing at a point 183' east of the west line of above described Lot 4 and 215' south of the north line of Lots 4, 5 and part of 6, thence southwesterly to a point 148' east of the west line of said Lot 4 and 308' south of the north line of said Lots 4, 5 and part of 6 and there terminating. It is the intention and agreement of the Parties hereto that the party of the second part shall in the construction, or maintenance of said watermain replace any shrubs or sod removed by any excavation in connection with such construction or mainten- ance work, in as nearly as possible the same condition as before such excavation. •rte i IN TESTIMONY WHEREOF, the said first party has caused these presents to be executed in its corporate name by itsVice President and Assistant Secretary and its corporate seal to be hereunto affixed the day and year first above written.
