BY MINUTES OF THE REGULAR MEETING OF THE EDINA BOARD OF APPEALS AND ADJUSTMENTS HELD FEBRUARY 16, 1978 at 5:30 P.M. EDINA CITY HALL CONFERENCE ROOM Members Present: Fred Richards, Chairman, William Lewis, Planning Commission Representative Staff Present: Harold Sand, Assistant Planner and Karen Sorensen, Secretary I. Approval of January 19, 1978 Board of Appeals Minutes Chairman Richards suggested that the Minutes should be continued to the next meeting when Mr. Miller and Mr. Runyan are in attendance. Chairman Richards pointed out that the Minutes should reflect that the procedure for agenda items should include: (1) presentation by proponent; (2) report of staff; (3) response by proponent; (4) response by public; and (5) action of Board. II. HEARINGS: B -78 -4 James Sorensen. 6455 McCauley Trail. Lot 4, Block 1, McCauley Heights 8th Addition. REQUEST: 20 foot front yard setback variance and /or 10 foot rear yard variance Mrs. Sorensen advised the Board that publication took place on February 1, 1978 and notice to affected property owners was mailed February 3, 1978. Affidavits of Notice and-Publication are on file. Mr. Sand stated that the subject property is a 150 foot wide by 110 foot deep lot that faces the County Road 18 frontage road, McCauley Trail. The property is zoned R -2 which is the same as the southerly adjacent lot; the northerly and easterly adjacent lots are zoned R -1. The dominant site characteristic is the steep slope from the north to south visually separating the property from the adjacent single family lot on the north side. The architect has attempted to design a structure that relates to the topography and utilizes the buildable area of the site to a maximum degree. The visible bulk of the dwelling falls within the setbacks, the below grade garages project into the required front yard setback approximately 17 feet. The variance request was published as a 20 foot front yard variance and a 10 foot rear yard variance to allow flexibility to shift the structure easterly if desired by the Board. The total variance required is 20 feet. The staff feels the proponents have presented a reasonable plan that relates well to the topography and setbacks. The staff is somewhat concerned about the grade of the driveway to the northerly unit. The proponent has provided a driveway turn around to help solve the problem. He has also agreet to shift the unit 5 feet easterly- to decrease the slope o:-* the driveway. d Board of Appeals and Adjustments Minutes Page Two February 16, 1978 ._. With that modification, the staff would recommend approval of the variances (15 foot front yard and 5 foot rear yard) for the following reasons: 1) th= unusual topography and depth of the lot create unusual circumstances that will be corrected by the proposed variance. 42) the variance will not be detrimental to the public welfare or wt adjacent property. 3) the variances will correct an unnecessary hardship. Tte staff would further recommend that the variance is contingent upon: 1) the plans presented. 2) the owner's understanding that the variance will in no way reduce the public right of access and use of the McCauley Road right -of -way, including, but not limited to: sidewalks, bicycle paths, utilities, snow storage, p_cestrian and vehicular traffic. Mr. James Sorensen stated that he had received a copy of the staff report and agreed with _zic conditions listed therein. He stated that the building will be lower than the site to the rear and to surrounding houses. It is hoped that this will be an energy saving structure. Chairman Richards asked Mr. Sand how do we make sure future owners of the property will be aware of these conditions. Mr. Sand replied that the conditions are filed in the building department and perhaps a copy can be filed with the Hennepin County Registrar of Deeds. Mr. Lewis moved approval of the requested 15 foot front yard and 5 foot rear yard variances for the reasons stated by the staff and subject to the conditions in the staff report and further, that a record of the variance be filed with the Hennepin County Registrar. Mr. Richards seconded the motion. All Voted Aye. Motion Carried. B -78 -5 Ryan Construction Co. 7501 York-Avenue South. Lot 1, Block 1, Yorkdale Townhomes of Edina. REQUEST: Parking variance to reduce enclosed parking by 23 stalls (.25 stalls per unit) Mrs. Sorensen advised the Board that publication took place on February 8, 1978 and notice to affected property owners was mailed February 3, 1978.
