AGREEMENT THIS AGREEMENT, Made and entered -into this -71 day of 1980, by and between DIVERSIFIED DIRECTIVES, INC., a Minnesota corporation [hereinafter called "Red Barn "], and RICHARD W. STEINER, also known as R. W. Steiner and Richard Warren Steiner, single, and ROBERT J. STEINER and LOREEN L. STEINER, husband and wife [hereinafter all together called "Steiner "], parties of the first part, and HOUSING AND REDEVELOPMENT AUTHORITY OF EDINA, MINNESOTA, a body politic and corporate under the laws of the State of Minnesota [hereinafter called "HRA "], party of the second part. WITNESSETH, THAT: WHEREAS, Red Barn, Steiner, and the HRA entered into an agreement on May 10, 1978 [ "Agreement "], whereby Steiner sold to the HRA the property [the "Driveway Area "] described in Exhibit A attached hereto and hereby made a part hereof and Red Barn released and conveyed its lessee's interest in the Driveway Area to the HRA. WHEREAS, pursuant to numbered Paragraph 9 of the Agreement, the parties hereto agreed to execute and deliver a supplemental agreement, in recordable form, that would establish the upper elevation of Parcel II of the Driveway Area, at a point sixteen (16) feet above the highest elevation of the finished grade of the driveway, as constructed by the HRA, by reference to an elevation above mean sea level, 1929 adjustment. WHEREAS, the City Engineer of the City of Edina has determined the highest elevation of the finished grade of the driveway to be 881.00 feet above mean sea level, 1929 adjustment. NOW, THEREFORE, for One Dollar ($1.00) and other good and valuable consideration to each of the parties hereto in hand paid, the receipt and sufficiency of which is hereby acknowledged by each party hereto, and in consideration of the mutual covenants and agreements hereinafter contained, Y the parties hereto do hereby enter into this Supplemental Agreement to the Agreement and do hereby agree, for themselves and their respective personal representatives, heirs, successors, and assigns, that the upper elevation of Parcel II of the Driveway Area is and shall be 897 feet above mean sea level, 1929 adjustment, and that Parcel II shall forthwith and hereafter be described as in Exhibit B attached hereto and hereby made a part hereof.
