SEWER THIS INSTRUMENT, Made this 9th day of January , 19 81, by and between Crossroads of Edina, a limited partner- ship under the laws of the State of rinnesota, party of the first part, and the City of Edina, a municipal corporation organized under the laws of the�State of Minnesota, party of the second part; 11ITNESSETH, that the said party of the first part, in consideration of One and No /100 Dollars ($1.00), to it in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, does Grant, Bargain, Sell, Convey, and Warrant to said party of the second part an Easement in perpetuity for storm sewer purposes, including the right to enter for the purpose of constructing, maintaining, altering, repairing and reconstructing a storm sewer system in, under, and over the following described property situate in the County of Hennepin and State of Minnesota, to -wit: An easement for storm sewer purposes over and across I.ot 1, Block 1; Lot 1, Block 2, FINDELL SECOND ADDITION, and also over and across vacated Amundson Avenue as dedicated on the plat of FINDELL SECOND ADDITION, said easement being 10 feet in width, the centerline of which is described as follows: Beginning at a point on the North line of said Lot 1, Block 1, distant 10.0 feet West of the Northeast corner at said Lot 1, Block l; thence South 0 degrees 09 minutes 30 seconds West, parallel with the East line of said Lot 1, Block 1, a distance of 223.0 feet; thence South 22 degrees 43 minutes 55 seconds West, 95.0 feet; thence North 88 degrees 20 minutes 30 seconds Nest, 207.0 feet and there terminating. It is the intention and agreement of the Parties hereto that the party of the second part shall in the con- struction, or maintenance-of said storm sewer replace any shrubs or sod removed by and any blacktop or concrete surfacing damaged or removed by, any excavation in con- nection with such construction or maintenance Work, in as nearly as possible the same condition as before such ex- cavation.
