Recorder and of the Registrar of Titles in and for Hennepin County,
Minnesota, as Document Nos. 4680132 and 1444852, respectively, and
pursuant to Paragraph 8 of that certain Agreement (Conditions to
Setback, Floor Area Ratios, and Lot Coverage Variances for One
Corporate Center Phase 6), of record in said offices as Document
Nos. 4680133 and 1445367, respectively, that FBS Mortgage Corpora-
tion ( "FBSMC ") is the owner and holder of a first lien mortgage,
of record in said offices as Document Nos. 4681054 and 1445368,
respectively, upon all of the above - described property, and that
