THIS INSTRUMENT, Made this 13th day of July ► 19-22—,
by and between Burch N. Bell and Okra ( Ra1I, husband and wi_fe__
, of the County of Hennepin
and State of Minnesota, parties of the first part, and the City of
Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in
consideration of One and No /100 Dollars ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do Grant, Bargain, Sell, Convey and Warrant to
said party of the second part an Easement in perpetuity for utility
purposes, including the right to enter for the purpose of construct-
ing, maintaining, altering, repairing and reconstructing utility
systems in and over the following described property situate in the
County of Hennepin and State of Minnesota, to -wit:

150feet of the north 580 feet except highway of Government Lot
3, Section 4, Township 116, Range 21 west of the 5th principal
meridian lying within a 15 foot wide strip of land, the centerZine
of which is described as foZZows:
Beginning at a point on the south line of said parcel,
which point is 22 feet west of the northeast corner of
Lot 5, Block 2, as platted in Oak Ridge of Edina; thence
northeasterly, at an arigZe of 56018' as turned from said
northeast corner of Lot 5, a distance of 76.70 feet; thence
northeasterly, at a deflection angle of 23Q09130" to the
left; to the north line of said south 150 feet of the north
580 feet of Government Lot 3 and there terminating.
The sidelines of said easement shall be extended to intersect
the property Zines.of the above described parcel.

it is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said utilities replace any shrubs or sod removed by
any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such
excavation.
