RESOLUTION VACATING EASEMENT FOR
DRAINAGE AND UTILITY PURPOSES
U'HEREAS, a resolution of the; City Council adopted the 16th day of November,
1981,fi.xed a date for a public hearing on a proposed vacation of easements for
utility and drainage purposes; and
14THEREAS,.two weeks' published and posted notice of said hearing was given and
the hearing was held on the 7th day of December, 1981, at which time all
persons desiring to be heard were given -an opportunity to be heard thereon;
and
WHEREAS, the Council deems it to be in the best interest of the City and of
the public that said easement vacations be made; and
k'1:EREAS, the Council has considered the extent to which the vacation affects-
:xisting easements within the area of the vacation and the extent to wi,.ich
the vacation affects the authority of. any person, corporation, or murici-
paiity owning or. control ling electric or telephone poles and lines, gas and
sewer lines, or water pipes, mains, and hydrants on or under the area as
the proposed vacation, to continue maintaining the same, or to enter upon
such easement area or portion thereof vacated to maintain, repair, replace,
ramove or otherwise attend thereto;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina,
He*nnepin County, Minnesota, that the following described easement for drain-
age and utility purposes.be and is hereby vacated, effective as of-Dacember
8, 1981:
':he Westerly ten (10) feet of Lot 3, except the Northerly ten (10)
feet and the Southerly fifteen (15) feet thereof; and the Easterly
anal Westerly ten (10) feet of Lot 2, except the Northerly, ten (10)
feet-and Southerly fifteen (15) feet thereof; and the Easterly ten
(10) feet of Lot 1 except the Northerly ten (10) feet and Southerly
fifteen (15) feet-thereof, all in Braewood mark;
prev " ed, however that after due consideration, the Council has determined
and hereby requires as a condition to this vacation that new easements for
util ity and drainage purpcses be granted over i
r and across the area desccibe
as follows:
The West 20.0 feet of the East 60.0 feet of Lot 2, Block 1, Braawood
Park; and the West 20.0 feet of the East 185.0 feet of Lot 1, Block 1.
Braewood Park; and
provided further, that after clue consideration, the Council has determined
and hereby requires as a further condition to this vacation that an
easement be continued for Northern States Power Company for maintenance, repair,
replacement, removal and otherwise attending thereto, all of the pipes, poles,
mains and lines now in, on or under the above vacated area described as
follows:
The Northerly 75 feet of Lots 1, 2 and 3, Block 1, Braewood Park.

ON VACATION OF EASEMENT FOR DRAINAGE AND UTILITY PURPOSES
• IN THE CITY OF EDINA, HENATEPIN COUNTY, MINNESOTA
NOTICE IS'•HEREBY GIVEN that the City Council of Edina, Hennepin County, Minne-
sota, oa November 16, 1981, adopted a Resolution Vacating Drainage and Utility
Easements, after public hearing and notice thereof as required by law an8 after
determining it to be in the best interest of the City and of the public that
said easement vacation be made, which resolution ordered the vacation of the
following described easement for utility and drainage purposes, all as-platted
and of record in the office of the Register of Deeds in and for Hennepin
County, Minnesota:

- Said vacetion reserves and retains by said Resolution Ordering the - Vacation,
the following easements and authority in, on or under the above vacated area:
The authority of the City of Edina and of Northern States Pcwer Co.
to enter upon the above vacated area to ma-intain, repair, replace,
remove, or otherwise attend thereto, all of the pipes, mdinc: lines
and hydrants for water, sanitary sewer or storm and water drainage,
now in, on 6r.under the above vacated area.

for all utility and drainage purposes including, but not being limited
to, sanitary
sewer, storm sewer, rater pipes, including the right to enter for

constructing, maintaining, altering, repairing and reconstructing

County of Hennepin and State of Minnesota, to -wit:

1; and
The West 20.0 feet of the East 80.0 feet of Lot 2, Block
1, all in
Braewood Park.
It is the intention and agreement of.the Parties hereto, that the
party of the second part shall in the construction, or maintenance of said utility
and drainage systems, replace any shrubs or sod removed by any excavation in
connection with such construction or maintenance work, in' as nearly as possible
the sane condition as before such excavation.
