HomeMy WebLinkAbout2298CITY OF EDINA 4801 WEST 50TH STREET, EDINA, MINNESOTA 55424 612- 927 -8861 F040) s RESOLUTION tv- 6zkd Its -ec� WHEREAS, the following described property is at present a single tract of land: That part of the North 334 feet of the Northwest Quarter of the Northeast Quarter lying east of the West 658.5 feet thereof and lying west of the west line of Brookview Avenue extended to the north line of the said Northwest Quarter of the Northeast Quarter in Section 30, Township 28, Range 24, the west boundary of said tract is marked by Judicial Landmarks set at the southwest corner thereof and at a point on the west line thereof 110.25 feet south of the Northwest corner thereof, except that portion of the above described tract lying southwesterly of the following described line constituting the center line of Valley View Road; Beginning at a point on the north line of the Northeast Quarter of said Section 30 distant 549.79 feet east of the northwest corner thereof; thence running southeasterly at an angle of 26036' with said north line, when measured from east to south for a distance of 500 feet and there terminating. WHEREAS, the owners have requested the subdivision of said tract into separate parcels (herein called "Parcels ") described as follows: Parcel A: That part of the North 334 feet of the Northwest Quarter of the Northeast Quarter lying east of the West 658.5 feet thereof and lying west of the west line of Brookview Avenue extended to the north line of the said Northwest Quarter of the Northeast Quarter in Section 30, Township 28, Range 24 the west boundary of said tract'is marked by Judicial Landmarks set at the southwest corner thereof and at a point on the west line thereof 110.25 feet south of the Northwest 'corner thereof; except that portion of the above described tract lying southwesterly of the following described line constituting the center line of Valley View Road; Beginning at a point on the north line of the Northeast Quarter of said Section 30 distant 549.79 feet east of the northwest corner thereof; thence running southeasterly at an angle of 260 36' with said north line, when measured from east to south for a distance of 500 feet and there terminating. Also except the East 45.33 feet of the above described tract; and Parcel B: The East 45.33 feet of the following described property: That part of the North 334 feet of the Northwest Quarter of the Northeast Quarter lying east of the West 658.5 feet thereof and lying west of the west line Brookview Avenue extended to the north line of the said Northwest Quarter of the Northeast Quarter in Section 30, Township 28, Range 24, the west boundary of said tract is marked by Judicial Landmarks set at the southwest corner thereof and at a point on the west line thereof 110.25 feet south of the Northwest corner thereof, except that portion of the above described tract lying southwesterly of the following described line constitut- ing the center line of Valley View Road; Beginning at a point on the north line of the Northeast Quarter of said Section 30 distant 549.79 feet east of the northwest corner thereof; thence running southeasterly at an angle of 260 36' with said north line, when measured from east to south for a distance of 500 feet and there terminating. Except the North 33 feet thereof, as set forth in Book 2035 of Deeds, page 415. WHEREAS, it has been determined that compliance with the Subdivision and Zoning Regulations of the City of Edina will create an unnecessary hardship and said Parcels as separate tracts of land do not interfere with the purposes of the Subdivision and Zoning Regulations as contained in the City of Edina Ordinance Nos. 801 and 825; NOW, THEREFORE, it is hereby resolved by the City Council of the City of Edina that the conveyance and ownership of said Parcels as separate tracts of land is hereby approved and the requirements and provisions of Ordinance No. 801 and Ordinance No. 825 are hereby waived to allow said division and conveyance thereof as separate tracts of land but are not waived for any other purpose or as to any other provision thereof, and subject, however, to the provisions that no further subdivision be made of said Parcels unless made in compliance with the pertinent ordinances of the City of Edina or with the prior approval of this Council as may be provided for by those ordinances.
