THIS INSTRUMENT, Made thisL day of
1987, by and between ANN KREBES, a single person and WILLIAM
KREBES, a single person, party of the first part, and the City
of Edina, a municipal corporation organized under the laws of
the State of Minnesota, party of the second part:
WITNESSETH, That the said party of the first part, in
consideration of One and No /100 Dollars ($1.00), to it in hand
paid by the said party of the second part, the receipt whereof
is hereby acknowledged, does Grant, Bargain, Sell, Convey, and
Warrant to said party of the second part an Easement in
perpetuity for public walkway purposes in, under, and over the
following described property situated in the County of
Hennepin and State of Minnesota, to -wit:
That part of Government Lot 7, Section 28, Township 117, Range
21, Hennepin county, Minnesota, according to the Government
Survey thereof, described as follows:
Commencing at the intersection of the northwesterly right -of-
way line of U.S. Highway No. 169, now known as C.S.A.H. No.
158, said right -of -way line being a line parallel with and
distant 50.00 feet northwesterly from the center line of said
highway, and the southerly right -of -way line of West 53rd
Street; thence Westerly along said southerly right -of -way
? line, a distance of 77.00 feet; thence Southeasterly
deflecting to the left 100 degrees 00 minutes 00 seconds, a
distance of 82.87 feet to an intersection with a line parallel
with and distant 60.00 feet northwesterly from the center line
of said C.S.A.H. No. 158; thence Southwesterly deflecting to
the right 40 degrees 16 minutes 59 seconds, a distance of
115.00 feet to an intersection with a line parallel with and
distance 50.00 feet northwesterly from the center line of said
C.S.A.H. No. 158; thence Southeasterly deflecting to the left
83 degrees 14 minutes 40 seconds, along a line radial to the
center line of said C.S.A.H. No. 158, a distance of 10.00 feet
to the point of beginning of the land to be described; thence
Northwesterly along last described radial line a distance of
3.00 feet; thence Southwesterly deflecting to the left 94
degrees 11 minutes 14 seconds, a distance of 18.91 feet;
thence Southerly deflecting to the left 29 degrees 17 minutes
25 seconds, a distance of 18.91 feet; thence Southerly
deflecting to the left 29 degrees 17 minutes 25 seconds, a
distance of 2.72 feet to the northwesterly right -of -way line
of said C.S.A.H. No. 158; thence Northeasterly along said
northwesterly right -of -way line being a curve concave to the
northwest having a radius of 1870.08 feet, a distance of 21.13
feet to the point of beginning.
Note: The City of Edina will remove the snow from the
sidewalk. The City of Edina will assume the liability
created by the sidewalk, except for liability, damage
or injury caused by the act or negligence of any or
all parties of the first part or any or all previous
owning parties or any or all possessing adjoining
property owners of the above described easement area.
IN WITNESS WHEREOF, the said first party has caused
these presents to be executed on the day and year first above
