THIS INSTRUMENT, Made this 5th day of April , 19 88 ,
by and between Walter G. Irwin & Karen S. Irwin husband and wife
, of the County of Hennepin and State
of Minnesota, parties of the first part, and the City of Edina, a municipal corporation
organized under the laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in consideration
of One and No 1100 Dollars ($1.00), to them in -hand paid by the said party of the
second part, the receipt whereof is hereby acknowledged, do Grant, Bargain, Sell,
Convey, and Warrant to said party of the second part an Easement in perpetuity for
storm water detention basin purposes, including the right to enter for the purpose
of constructing, maintaining, altering, repairing and reconstructing a storm water
detention basin system in, under, and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit:
That part of Lot 14, Block 3, Killarney Shores, described as follows:
Commencing at the Northwest corner of said Lot 14, said point being the
beginning of the parcel to be described; thence Easterly along the North line of
Lot 14 25.00 feet; thence South 12 degrees 30 minutes 25 seconds East parallel with
the West line 72.08 feet to the South line of said Lot 14; thence Westerly along
the South line 26.80 feet to the Southwest corner of said Lot 14; thence Northerly
along the West line 62.43 feet to the Northwest corner of said Lot 14 and there
terminating.
The Grantors, for themselves, their heirs, executors, successors and assigns
to hereby covenant and agree that they will permit the above described property to
remain as a part of a storm water detention basin for the drainage and storage of
surface waters and that they will not fill the same nor will they in any manner attempt
to change the grade level of the same nor interefere with the natural drainage, flowage
and storage of surface water on the above described property.
