EASEMENT FOR STORM WATER DETENTION BASIN

THIS INSTRUMENT, Made this 5th day of April 19 88,
by and between Wally Irwin Constr., Inc.
a corporation under the laws of the State of Minnesota, party of the first part,
and the City of Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;
WITTNESSETH, That the said party of the first part, in consideration of
One and No /100 Dollars ($1.00), to it in hand paid by the said party of the second
part, the receipt whereof is hereby acknowledged, do Grant, Bargain, Sell, Convey,
and Warrant to said party of the second part an Easement in perpetuity for storm
water detention basin purposes and /or holding pond, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and reconstructing
a storm water detention basin and /or holding pond system in, under, and over the
following described property situate in the County of Hennepin and State of Minnesota,
to -wit:
That part of Lot 18, Block 3, Killarney Shores, described as follows:
Commencing at the Northeast corner of said Lot 18, said point being the
beginning of the parcel to be described; thence Southerly along the East line 62.43
feet to an angle point on the East line of said Lot 18; thence Southwesterly 78.31
feet to the Southeast corner of said Lot 18; thence West along the South line of
said Lot 18 25.00 feet; thence North 4 degrees 0 minutes 11 seconds West 10.00 feet;
thence North 42 degrees 11 minutes 42 seconds East parallel with the Easterly line
of said Lot 18 76.33 feet; thence North 12 degrees 30 minutes 25 seconds West parallel
with the East line 52.55 feet to the North line of said Lot 18; thence Easterly along
the North line 25.00 feet to the Northeast corner of said Lot 18 and there terminating.
The Grantor, for itself, its heirs, executors, successors and assigns,
does hereby covenant and agree that the above - described property will be and remain
as a part of a storm water detention basin for the drainage and storage of surface
waters and that it and they will not fill the same nor will it and they in any manner
attempt to change the grade level of the same nor interfere with the natural drainage,
flowage and storage of surface water into or on the above - described property.
