EASEMENT FOR STORM SEWER

the first part, and the City
organized under the laws of the
second part;
this 15th day of September
York Cooperative, a cooperative

WITNESSETH, That the said party of the first part, in
consideration of One and No /100 Dollars ($1.00), to it in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do grant, bargain, sell, convey and warrant
to said party of the second part an Easement in perpetuity for
storm sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing, and
reconstructing a storm sewer system in, under and over the
following described property situate in the County of Hennepin
and State of Minnesota, to wit:
A Permanent Storm Sewer Easement 5 feet either side of a line
described as follows: Commencing at the Southwest corner of Lot
1, Block 1, Ebenezer Society 1st Addition; thence North on an
assumed bearing of North 0 degrees 19 minutes 43 seconds West
along the West line of said Lot 1 30.00 feet to the point of
beginning, thence North 87 degrees 40 minutes 17 seconds East
54.00 feet and there terminating.
The line 5 feet either side of the described line shall be
extended or shortened to intersect with the West line of said Lot
1.
It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction of
said storm sewer replace any trees, shrubs, sod, or underground
sprinklers removed by any excavation in connection with such
construction, in as nearly as possible the same condition as
before such excavation.
