EASEMENT FOR PUBLIC ROAD PURPOSES
THIS INSTRUMENT, Made this 15th day of
September
1989 , by and between 7500 York Cooperative, a cooperative
association under the laws of the State of Minnesota, party of
the first part, and the City of Edina, a municipal corporation
organized under the laws of the State of Minnesota, party of the
second part;
WITNESSETH, That the said party of the first part, in
consideration of One and No /100 Dollars ($1.00), to it in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do grant, bargain, sell, convey and warrant
to said party of the second part an Easement in perpetuity for
public road purposes, in, under and over the following described
property situate in the County of Hennepin and State of
Minnesota, to wit: '
An Easement for Roadway Purposes, Lot 1, Block 1, Ebenezer
Society 1st Addition, a recorded plat located in Hennepin County, -
Minnesota described as follows:
Commencing at the Southwest corner of Lot 1, Block 1, Ebenezer
Society 1st Addition; thence North on an assumed bearing of North
0 degrees 19 minutes 43 seconds West along the West line of said
Lot 1, Block 1 16.50 feet; thence North 89 degrees 55 minutes 42
seconds East parallel with the South line of said Lot 1,250.00
feet; thence South 0 degrees 19 minutes 43 seconds East 13.00
feet thence South 86 degrees 09 minutes 26 seconds East 51.27
feet to the south line of said Lot 1; thence South 89 degrees 55
minutes 42 seconds West along the South line of said Lot 1 301.13
feet to the point of beginning and there terminating.
It is the intention and agreement of the Parties
hereto that the party of the second part shall in this
construction project, replace any trees, shrubs, sod, or
underground sprinklers removed by any excavation in connection
with such construction work, in as nearly as possible the same
condition as before such excavation.
