EASEMENT FOR STORM SEWER
THIS INSTRUMENT, Made this 5th day of April
, 19 89 , by and between Aloysius R. Cheney, Single
Barbara C. Cheney aka
and Barbara Cheney Single of the County of Hennepin and State
of Minnesota, parties of the first part, and the City of Edina,
a municipal corporation organized under the laws of the State of
Minnesota, party of the second part;
WITNES.SETH, That the said parties of the first part, in
consideration of One and No /100 Dollars ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do Grant, Bargain, Sell, Convey and Warrant
to said party of the second part an Easement in perpetuity for
storm sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and
reconstructing a storm sewer system in and over the following
described property situate in the County of Hennepin and State of
Minnesota, to -wit:
An easement for storm sewer purposes, Lot 5, Block 3, Indian -W
Hills Arrowhead Addition described as follows:
Commencing at the Southeast corner of Lot 5, Block 3, Indian
Hills Arrowhead Addition, a recorded plat in Hennepin County,
Minnesota; thence West on an assumed bearing of West along the
South line of said Lot 5, 30.00 feet; thence North 15.00 feet;
thence East parallel with the South line of said Lot 5, 26.55
feet to the intersection of the East line of said Lot 5; thence
South along the East line of said Lot 5 on a curve concave to the
Northeast with a central angle of 3 degrees 07 minutes 24 seconds
and a radius of 282.37 feet, 15.39 feet to the point of beginning
and there terminating.
It is the intention and agreement of the Parties
hereto that the party of the second part shall in the
construction, or maintenance of said storm sewer replace any
shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the
same condition as before such excavation.
