Gustafson and Ethel Gustafson ( "Gustafson "), as owners of Lot 16, and GAC Partners ( "GAC"), as owner of Lot 17, Block 1, Indian Hills 3rd Addition. W I T N E S S E T H: WHEREAS, GAC has a 4" sewer stub along the southeasterly lot line to service one of the two homes on Lots 16 and 17. The City of Edina will permit the sharing of this sewer line between both homes under the following conditions: A manhole is installed by GAC along the southerly lot line of Lot 17 which is 36.37 feet in length. Four -inch cast iron services from each of the two homes may be stubbed into the manhole, with one four -inch line from the manhole to the city main. WHEREAS, GAC has one 1 -1/2 inch water service stub along the same southeasterly lot line referred to above. The City of Edina will permit the sharing of this water service between both homes under the following conditions: In the proximity of the new manhole referred to above there will be three water shut offs installed. One will shut off all water to both homes; one will shut off just Lot 16; one will shut off just Lot 17. Each home will be equipped with a residential pressure /holding tank as already installed in Lot 16 to assure adequate water pressure. WHEREAS, it is further agreed to by all parties as follows: The City of Edina is not assuming, incurring or agreeing to any expense or liability or to any future liability for expense or maintenance of any of these lines between the City of Edina owned "main lines" located within the street limits of Timber Ridge and the two houses. Gustafson and GAC hold the City of Edina completely harmless for any malfunctions including, but not limited to, backup caused by any reason or source. The City of Edina makes no representations as to the adequacy of or to the engineering of these shared services. The City of Edina is allowing this shared installation solely due to the fact of the difficulty and expense of installing a second line without an abnormal disruption of the natural wooded hillside that benefits these two homes as well as other homes in the area. Further, all parties agree that the City of Edina assumes no ownership of any of the equipment or manhole that is necessary for the sharing of these services. The City of Edina is not responsible for any maintenance or repair of any lines beyond the city owned main lines.
