HomeMy WebLinkAbout2529� � Y EASEMENT FOR DRAINAGE AND FLOWAGE OF SURFACE WATERS KNOW ALL MEN BY THESE PRESENTS, That the Grantors Brookside III _Condominium Association a Minnesota non - profit corporation, residing in the County of Hennepin, and State of Minnesota, for and in consideration of the sum of One and No /100 Dollars ($1.00) and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, do hereby Convey and Warrant to the City of Edina, a municipal corporation under the laws of the State of Minnesota, as Grantee, a perpetual easement in, over, under and upon the following described property, to -wit: 4360 Brookside Court, a Condominium, Apartment ownership No. 67 Beginning at the northeast corner of Lot 2, Block 1, Dietrich's Brookside Court; thence south 130.00 feet; thence west 85.00 feet; thence north to the intersection of the north line of Lot 2, Block 1, Dietrich's Brookside Court; thence northeasterly along said north line to the intersection of the north line of Section 28, Township 117, Range 21; thence east to the point of beginning, for the purpose of drainage and flowage, of surface waters. The Grantors, for themselves, their heirs, executors, successors and assigns do hereby covenant and agree that they will permit the above described property to remain as a part of the drainage of surface waters and that they will not fill the same nor will they in any manner attempt to change the grade level of the same nor interfere with the natural drainage or flowage of surface water on the above described property. The Grantor further agrees for itself, its members, successors, and assigns that the City of Edina will have no duty to maintain or service the above described property except for maintenance of the riprap channel of the flume nor shall it be liable in any manner or to any party in connection with the maintenance of the above described property as part of the drainage of surface water system apart from liability associated with the maintenance of the riprap channel of the flume. � � r Dated this day of 11999.
