THIS INSTRUMENT, made this °?- day of DECEM6E'� , 2000, by and
between Michael F. Kelly and Mary H. Kelly, husband and wife, of the County of Hennepin
and State of Minnesota, parties of the first part, and the City of Edina, a municipal corporation
organized under the laws of the State of Minnesota, party of the second part;
WITNESSETH, that the said parties of the first part, in consideration of One and
No /100 Dollars ($1.00), to them in hand paid by the said party of the second part, the receipt
whereof is hereby acknowledged, does grant, bargain, sell, convey and warrant to said party
of the second part an easement for the purposes hereinafter set forth, in and over the
following described property situated in the City of Edina, County of Hennepin and State of
Minnesota, to wit:
Utility Easement for 22 Circle West shown on Exhibit A hereto, as follows:
Said easement is described as follows:
THAT PART OF CIRCLE WEST AS DEDICATED ON THE PLAT OF HILLDALE- LALONE
ADDITION, ACCORDING TO THE RECORDED PLAT THEROF, HENNEPIN COUNTY,
MINNESOTA COMMENCING AT THE SOUTHEAST CORNER OF SAID CIRCLE WEST;
THENCE NORTH 78 DEGREES 16 MINUTES 00 SECONDS WEST ASSUMED BEARING
ALONG THE SOUTHERLY LINE OF SAID CIRCLE WEST A DISTANCE OF 36.05 FEET TO
THE EAST LINE OF CIRCLE WEST; THENCE NORTH 05 DEGREES 19 MINUTES 14
SECONDS EAST A DISTANCE OF 4.92 FEET; THENCE SOUTH 78 DEGREES 16 MINUTES
00 SECONDS EAST A DISTANCE OF 36.61 + /- FEET; THENCE SOUTH 11 DEGREES 44
MINUTES 00 SECONDS WEST A DISTANCE OF 5 FEET TO THE POINT OF BEGINNING.
It is the intention and agreement of the parties hereto that the party of the second
part shall in the construction, or maintenance of said utilities, replace any sod removed by any
excavation in connection with such construction or maintenance work, in as nearly as possible
the same condition as before such excavation.
IN WITNESS WHEREOF, the said parties of the first part have hereunto set their
hands the day and year first above written.
