EASEMENT FOR STORM SEWER
THIS INSTRUMENT, made this 22nd day of November , 1996, by and
between Edward M. Noonan and Lisa Hayes Noonan
of the County of Hennepin and State of Minnesota, parties of the first part, and the City of
Edina, a municipal corporation organized under the laws of the State of Minnesota, party of
the second part;
WITNESSETH, that the said parties of the first part, in consideration of One and Noi100
Dollars ($1.00), to them in hand paid by the said party of the second part, the receipt whereof
is hereby acknowledged, does grant, bargain, sell, convey and warrant to said party of the
second part an easement for the purposes hereinafter set forth, in and over the following
described property situated in the City of Edina, County of Hennepin and State of Minnesota,
to wit:
Storm Sewer Easement for 4700 Merilane
An easement for storm sewer purposes across Lot 60A, Rolling Green Section Two. Said
easement is described as follows:
Commencing at the Southeast corner of said Lot 60A; thence Northwesterly along the
East line of said Lot 60A, on a nontangential curve, concave to the Northeast, having a
radius of 338.50 feet, a centrae angis of 1 :egree 38 minutes 56 seconds, an assumed
chord bearing of North 4C egrees 56 mi utes 58 seconds West, a distance of 9.74 feet,
to the point of beginning o said easeme t. Thence South 88 degrees 41 minutes 53
seconds West, a distance c f 25.00 feet; t ence North 35 degrees 0 minutes 0 seconds
East, a distance of 20.83 feet more or les to the East line of said Lot 60A; thence
Southeasterly along the Ea t line of said Lot 60A, on a nontangential curve, concave to
the Northeast, having a rad us of 338.50 et, a central angle of 3 degrees 33 minutes 37
seconds on an assumed ch rd bearing o South 38 degrees 20 minutes 42 seconds East
a distance of 21.03 feet mo a or less to t e point of beginning.
It is the intention and agreement of the parties hereto that the party of the second part
shall in the construction, or maintenance of said storm sewer, replace any sod removed by
any excavation in connection with such construction or maintenance work, in as nearly as
possible the same condition as before such excavation.
