Grantee shall use his best efforts to install a water line within the Easement Area through the soil boring method of installation rather than through the trench method of installation. Notwithstanding the foregoing, Grantee shall not be required to use the soil boring method if the cost to do so for Grantee exceeds $11,000.00. 2. If Grantor's existing brick driveway is damaged as a result of Grantee's activities in the Easement Area,. Carantee shall use Yellow: Brick Road, Inc. to repair and restore the damaged portion of the brick driveway to its original condition at Grantee's cost and expense; provided, Grantee shall not be required to use Yellow Brick Road, Inc. if its charges for labor exceeds its normal hourly rate for labor, or if its charges for material exceed its normal charges for identical materials. 3. If Grantee damages any grass, shrubs or trees in the Easement Area, Grantee shall repair and restore the grass, shrubs and trees to their original condition. 4. All provisions of this appurtenant easement, including the benefits and burdens, run witb-the laud and are binding upon and inure to the benefit of the parties' successors and assigns. 5. Grantee shall reimburse Grantor for its actual, reasonable attorneys fees incurred in reviewing and negotiating this easement up to but not exceeding an amount of $1,500:00. S. Grantor shall reasonably cooperate with Grantee at no expense to Grantor in obtaining the subordination of Grantor's mortgage lien or liens to this easement. 7. Grantor hereby agrees that any existing sanitary sewer lines outside of the Easement Area eari°remain in the current location. if however, the sanitary sewer lines need to be repaired or replaced, Grantee shall abandon the existing sanitary sewer lines and place the new sanitary sewer lines entirely within the Easement Area.
