HomeMy WebLinkAboutResolution No. 2021-44 Approving Prelim Rezoning 4040 W 70th St RESOLUTION NO. 2021-44 APPROVING PRELIMINARY REZONING FROM PCD-3, PLANNED INDUSTRIAL DISTRICT TO PUD-22, PLANNED UNIT DEVELOPMENT – 22, AT 4040 WEST 70TH STREET BE IT RESOLVED by the City Council of the City of Edina, Minnesota, as follows: Section 1. BACKGROUND. 1.01 The applicant, Ecumen and Lupe Development Partners, are requesting a redevelopment of 4040 70th Street West to tear down the existing office building and construct a new three- four story 118 senior affordable housing project with 86 underground and 23 surface parking stalls. 1.02 The property is 1.58 acres in size. This site is guided in the Comprehensive Plan as OR, Office Residential. The site has a height limit of 4 stories and 48 feet. The density proposed is consistent with the Comprehensive Plan/Southdale District Plan which limits the density to 75 units per acre for this site. 1.03 The property is legally described as follows: Tract C, Registered Land Survey No. 1365, Hennepin County Minn. 1.04 To accommodate the request, the following is required: 1. A Rezoning from PCD-3, Planned Commercial District to PUD, Planned Unit Development, and 2. Preliminary Development Plan. 1.05 On May 12, 2021 after published and mailed notice in accordance with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. The Planning Commission recommended approval of the requests. Vote: 8 Ayes and 1 Nays. 1.06 On June 15, 2021 the City Council approved the request. Section 2. FINDINGS 2.01 Approval is based on the following findings: 1. Affordable housing is identified as a need in the Comprehensive Plan; and the proposed amendment would assist the City in meeting its established affordable housing goal with the Met Council of providing 1,804 new affordable housing units by the year 2030. This project would include 118 new affordable housing units toward that goal. RESOLUTION NO. 2021-44 Page 2 2. The proposed land use is consistent with the Comprehensive Plan and meets the criteria for a PUD. 3. The proposed density of 75 units per acre is reasonable, and within the density range suggested in the Comprehensive Plan of between 20-75 units per acre. 4. The existing roadways and parking would support the project. Wenck Associates conducted a traffic impact study and concluded that the proposed development could be supported by the existing roads and the proposed parking. 5. Project would meet the following additional Comprehensive Plan goals and objectives: a) Encourage the development and maintenance of a range of housing options affordable to residents at all income levels and life stages. b) Support the development of a wide range of housing options to meet the diverse needs and preferences of the current and future Edina community. c) Encourage infill and redevelopment opportunities that optimize use of city infrastructure, complement community context and character, and respond to needs at all stages of life. 6. The project would provide a transition from the single-family residential district to the west to the Southdale commercial district to the east. Section 3. APPROVAL NOW THEREFORE, it is hereby resolved by the City Council of the City of Edina, approves the Preliminary Rezoning from PCD-3, Planned Commercial District to PUD-22, Planned Unit Development District and Preliminary Development Plan for 4040 West 70th Street. Approval is subject to the following conditions: 1. The Final Development Plan must be generally consistent with approved Preliminary Development Plans dated April 12, 2021. 2. Sustainable design. The design and construction of the entire project must be done with the Sustainable Initiatives as outlined in the applicants Sustainability Questionnaire. 3. All buildings must be built with sprinkler systems, subject to review and approval of the fire marshal. Compliance with all of the conditions outlined in the building official and fire marshal memo dated May 5, 2019. 4. Compliance with all of the conditions outlined in the director of engineering’s memo dated May 6, 2019. 5. Compliance with all of the conditions outlined in the transportation planner’s memo dated May 6, 2019. RESOLUTION NO. 2021-44 Page 3 6. The Final Landscape Plan must meet all minimum landscaping requirements per Chapter 36 of the Zoning Ordinance. 7. The Final Lighting Plan must meet all minimum landscaping requirements per Chapter 36 of the Zoning Ordinance. 8. Final Rezoning is subject to approval of the Zoning Ordinance Amendment establishing the PUD-22, Planned Unit Development-22 District on this site. 9. Submit a copy of the Nine Mile Creek Watershed District permit prior to issuance of a building permit. The City may require revisions to the approved plans to meet the district’s requirements. 10. A Site Improvement Performance Agreement is required at the time of Final Approval. 11. Compliance with the Wenck Traffic Study recommendations. 12. A performance bond, letter-of-credit, or cash deposit must be submitted for one and one-half times the cost amount for completing the required landscaping, screening, or erosion control measures at the time of the first building permit.
