CERTIFICATE OF COMPLETION
AND
RELEASE OF SITE IMPROVEMENT PERFORMANCE AGREEMENT
Date: August 4, 2021
WHEREAS, the CITY OF EDINA, a Minnesota municipal corporation ("City") and
AMUNDSON FLATS, LIMITED PARTNERSHIP, a Minnesota limited partnership
("Developer") entered into a Site Improvement Performance Agreement dated July 21, 2020
("SIPA") and recorded May 27, 2021 as Hennepin County Document No. T5840739; and
WHEREAS, the SIPA provided for the redevelopment of a parcel of land legally described
as: Lot 1, Block 1, Amundson Flats, according to the recorded plat thereof, Hennepin County,
Minnesota; and
WHEREAS, Developer has complied with all terms and conditions of the SIPA and that
any sums due and owing under the SIPA have been satisfied.
NOW, THEREFORE, pursuant to Paragraph 18 of the SIPA, the undersigned, on behalf
of the City, certify that the Developer has complied with all terms and conditions of the SIPA.
THIS CERTIFICATE SHALL BE CONCLUSIVE DETERMINATION OF THE
SATISFACTION AND TERMINATION OF THE SITE IMPROVEMENT PERFORMANCE
AGREEMENT AND COVENANTS IN THE AGREEMENT.
