Election of Officers Director Teague indicated a new Chair and Vice Chair of the Commission would need to be selected due to former Chair Nemerov’s resignation. Commissioner Bennett moved to elect Commissioner Agnew as Chair of the Planning Commission. Commissioner Alkire seconded the motion. Motion carried unanimously. Commissioner Agnew moved to elect Commissioner Berube as Vice Chair of the Planning Commission. Commissioner Olsen seconded the motion. Motion carried unanimously. B. Resolution No. B-21-31 Proposed Eden Willson TIF District Draft Minutes☒ Approved Minutes☐ Approved Date: ___, 2021 Page 2 of 4 Economic Development Manager Neuendorf presented the request for a proposed Eden Willson TIF District. Staff recommends approval of the Eden/Willson TIF District plan. Commissioner Olsen moved to find that the tax increment financing plan for the Eden/Willson Tax Increment Financing District conforms to the general plans for the development and redevelopment of the City. Commissioner Bennett seconded the motion. Motion carried unanimously. VI. Community Comment None. VII. Public Hearings A. B-21-30 – Variance from Side Setback at 5608 Dale Ave Assistant Planner Aaker presented the request for a variance from Side Setback at 5608 Dale Ave . Staff recommends approval of the variance, as requested subject to the findings and conditions listed in the staff report. Public Hearing None. Commissioner Miranda moved to close the public hearing. Commissioner Strauss seconded the motion. Motion carried unanimously. Appearing for the Applicant Mr. Michael and Mrs. Maddie Lund, applicants, introduced themselves and addressed the Commission. Motion Commissioner Bennett moved that the Planning Commission recommend approval of the variance from side setback at 5608 Dale Ave as outlined in the staff memo subject to the conditions and findings therein. Commissioner Alkire seconded the motion. Motion carried unanimously. B. Zoning Ordinance Amendment, Revised Overall Development Plan, Site Plan Review – 7001 and 7025 France Avenue Director Teague presented the request for a Zoning Ordinance Amendment, Revised Overall Development Plan and Site Plan Review. Staff recommends approval as requested subject to the findings and conditions listed in the staff report. Staff answered Commission questions. The Commission asked questions of the applicants. Public Hearing Ms. Lori Grotz, 5513 Park Place, addressed the Commission with her concerns. Commissioner Miranda moved to close the public hearing. Commissioner Bennett seconded the motion. Motion carried unanimously. The Commission addressed concerns as well as recommended additional changes to the applicants.  Likes the public space but cannot support the new changes  Wants height in this part of Southdale  Needs affordable housing over a parking ramp  Likes the removal of the turn lane on France and the Park being moved to a new location  Likes the removal of the parking entrances on Ewing Avenue  Many problems with the parking structure  Need parking maximums in this development  Lack of affordable housing and the parking structure is a big issue  Potential benefits of a plaza are a plus  Possibility to bike here from other areas  Cannot support a 540-stall parking structure  Less store fronts in the new design does not require more parking spaces  Likes the modern idea  9 Mile bike path takes a person to the development  Great project for the site but should expand up one level  Too much parking without much retail  Likes the new vehicle access points  Likes market scape but could be done as previously drafted Motion Commissioner Olsen moved that the Planning Commission recommend denial to the City Council of the Zoning Ordinance Amendment, revised overall development plan, site plan review at 7001 and 7025 France Avenue, based on the findings in the staff report. The existing site is zoned PCD-4, Planned Commercial District, which allows only automobile service centers, gas stations and car washes. Restaurants and offices are allowed uses in the PCD-1, Planned Commercial Zoning District. To accommodate the request the following would be required:  A Rezoning from PCD-4, Planned Commercial District 4 to PCD-1, Planned Commercial District 1.  Building Addition Setback Variances: 1) Front Setback Variance to Eden Prairie Road from 35 to 13 feet; and 2) Side Yard setback variance from 25 to 5 feet.  A Front Setback Variance for the patio built toward Eden Prairie Road from 35 feet to 1-foot;  A Parking Stall Variance from 33 stalls to 26; and  A Comprehensive Plan Amendment from Medium Density Residential to Neighborhood Node. As with all sketch plan reviews; the Planning Commission is asked to provide non-binding comments and direction on a potential future development request. Areas of focus should be on the proposed land use and Comprehensive Plan Amendment; the proposed setbacks and how this proposal fits in to the surrounding area, such as the location of the outdoor dining area across the street from single-family homes. Staff has concern regarding the impact the proposal would have to the adjacent residential uses and the large variances requested. The proposed uses do not meet the city’s requirement for restaurant and office parking. A parking study would be done to determine if what is proposed is adequate. Staff has concerns regarding the possibility of parking extending into the residential area as proposed. City of Edina • 4801 W. 50th St. • Edina, MN 55424  Setbacks. Staff has significant concerns regarding the proposed setbacks for the building expansion and the patio for outdoor dining. The outdoor dining would be located across the street from single-family homes with a one-foot setback. The building addition is just 5 feet from the west lot line adjacent to residential uses (condominiums) to the west. The parking area is an existing condition. There is very little room to provide adequate screening on the subject property.  Green Space. There is very little green space or landscaping on the subject property. While this is an existing condition, the proposed plans do not make the situation any better; rather, the proposed addition takes away more green space. As demonstrated below there are screening requirements for uses near R-1 Zoning Districts.  Screening of parking and use. Per Section 36-1457 (4) of the Zoning Ordinance: “Off-street parking facilities containing six or more spaces and all loading facilities shall be screened from streets located within 50 feet, and from lots which are used for any residential purpose which are located within 50 feet. Said distance shall be the shortest distance between the parking facility or loading facility and the nearest part of the street or the nearest lot line of the residential lot.” This site is located within 50 feet of residential uses to the west and north.  Screening of the principal building. Per Section 36-1457 (1) of the Zoning Ordinance: “Nonresidential principal buildings or structures, and any building or structure accessory thereto, shall be screened from lots in the R-1 district which are used for single dwelling unit buildings and which are located within 200 feet of the nonresidential use. The distance shall be the shortest distance between the nonresidential building or structure to be screened and the nearest lot line of the R-1 district lot but shall not extend across a street.”  Trash Enclosure. Detailed information would have to be provided for the trash enclosure. Trash storage facilities, including recycling storage facilities, shall be screened from all lot lines and public road rights-of-way. As proposed the trash enclosure would be located right on the lot line. Per Section. 36-1460 all required screening shall be located on the lot occupied by the use, building, facility or structure to be screened. No screening shall be located upon any public road right-of-way, or within 20 feet of the traveled portion of a street.  Sidewalks. A sidewalk would be required to be installed along Vernon Avenue per the Bike and Pedestrian Master Plan.  Sustainability Questionnaire. The applicant would be required to fill out the Sustainability Questionnaire. AT TAC HME N T S: Description Work Group Green Print Board and Commission Working Group Greenprint BOARD/COMMISSION: Planning Commission WORKING GROUP NAME: Cahill District Area Plan Working Group WORKING GROUP OBJECTIVE: Complete a District Area Plan to be adopted into the City’s Comprehensive Plan WORKING GROUP CO-CHAIRS: Kate Agnew and David Alkire Project Title A working group may have more than one project. Cahill District Area Plan Description Describe the project. How does the project relate to the Board/Commission work plan? The intent is to work with Co-Chairs, City staff and its consultant to engage neighborhood residents, businesses, and other stakeholders in the Study Area for the purposes of developing and drafting a District Area Plan to be adopted into the City’s Comprehensive Plan. Additionally, the Work Group will participate in working meetings and will present the recommended District Area Plan to the Planning Commission. This area was identified in the current Comprehensive Plan as an area to be further studied and expanded from the 70th and Cahill Small Area Plan. Purpose Describe the purpose or objective of the project. e.g. develop a process, review the work The purpose is to complete a Cahill District Area Plan to be adopted into the City’s current Comprehensive Plan. Work Group members are asked to take a leadership role and to serve as “champions” for the District Area Plan, and to help draft the final document. Expertise in planning related fields are desirable to assist with the drafting of the plan. Duration of the Group Typically six months to two years. The plan will be developed over the course of 12-15 months, beginning in 2022. Deliverables Tangible or intangible object produced as a result of the project intended to be delivered to the indicated audience. The deliverable will be a District Area Plan for the Cahill District to be incorporated into the City’s current Comprehensive Plan. Community Benefit How does this project benefit the Edina community? The District Area Plan will provide a detailed framework to guide development within the Cahill District. Key Dates Is there an event or a timeframe to complete certain steps? The planning process for the working group will take place over approximately 12-15 months. It is anticipated that the District Area Plan Work Group would meet 2 times per month and will help facilitate District Area Plan workshops with the community at-large. There will be possible additional check-ins with the group as the plan is completed. Board and Commission Working Group Greenprint Promotion & Implementation What is the plan to share the project findings/completion or how will the completed project be implemented? The Cahill District Area Plan will be presented to the Planning Commission for review and recommendation to the City Council for approval. The findings and completion of the Cahill District Area Plan will be adopted into the City’s current Comprehensive Plan. Evaluation How will the group evaluate the findings or end result of the project? The Work Group will work with the consultant team to collaboratively produce findings to populate a District Area Plan. Recap of Work Group meetings and action items will be made available to the public. Membership & Time Commitment Working group size cap recommendation is 11 members. Estimate how much time a working group member needs to commit to. Approximately 12-15 months
