RESOLUTION NO. 2021-109
VACATING DRAINAGE AND UTILITY EASEMENT
PENTAGON VILLAGE
WHEREAS, an application was received on October I, 2021 from Pentagon Village, LLC of Pentagon Village, Lot
3, Block I, requesting that the utility easement be vacated; and
WHEREAS, two weeks published and posted notice was given and the hearing was held on November 16, 2021,
at which time all persons desiring to be heard were given an opportunity to be heard thereon; and
WHEREAS, the City Council has determined that the utility easement is not needed for public purposes; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edina, Hennepin County,
Minnesota:
I. That the following described utility easement is hereby vacated:
That part of the 20.00 foot wide drainage and utility easement over, under and across Lot 3, Bloclc I,
PENTAGON VILLAGE, according to the recorded plat thereof, Carver County, Minnesota, the centerline of
said easement is described as follows:
Commencing at the northwest corner of said Lot 3; thence North 90 degrees 00 minutes 00 seconds East,
assumed bearing along the north line of said Lot 3 for 88.25 feet: thence South 00 degrees 00 minutes 03
seconds West, a distance of 15.99 feet to the point of beginning of the centerline to be described: thence
continuing South 00 degrees 00 minutes 03 seconds West, a distance of 20.99 feet, and said centerline there
terminating.
2. The vacation shall not affect the authority of any person, corpora on, or municipality owning or controlling
the electric or telephone poles and lines, gas and sewer lines, wa pipes, mains and hydrants thereon or
thereunder, if any, to continue maintaining the same or to enter u• such way or portion thereof vacated to
maintain, repair, replace, remove, or otherwise attend thereto.
3. That the Mayor and the City Manager are authorized to execute . ] • .cuments necessary, in the opinion of the
City Attorney, to affect the transfer of this property.
