HomeMy WebLinkAboutResolution No. 2023-17 Preliminary Site Plan 5146 Eden Ave. RESOLUTION NO. 2023-17 APPROVING PRELIMINARY DEVELOPMENT SITE PLAN FOR THE CONSTRUCTION OF A RESTAURANT WITHIN PUD-24 AT 5146 EDEN AVENUE BE IT RESOLVED by the City Council of the City of Edina, Minnesota, as follows: Section 1. BACKGROUND. 1.01 Jester Concepts is proposing to re-develop portion of the 3.3-acre vacant old public work site at 5146 Eden Avenue with a 13,500 square foot restaurant. 1.02 Approval of PUD-24 was granted by the City Council in 2022 for this site. The development will include the following three phases:  Phase 1 – A 6-1/2-story, 86-unit senior cooperative project (owner occupied) with underground parking. (Applewood Pointe Cooperative) Ten percent (10%) of the units would be for affordable housing (9 units).  Phase 2 – A two/three-story, 13,500 square foot 347 seat restaurant with 30 surface parking stalls. Additional parking would rely on the public Jerry’s parking ramp to the west.  Phase 3 – A 31,643 square foot green space/public plaza area with pedestrian walkways to the pedestrian bridge, now under construction, that will connect the Jerry’s parking ramp. 1.03 Jester Concept is seeking Preliminary Site Plan approval for the restaurant. Preliminary Site Plan has been granted for Phase 1. 1.04 The property is legally described as follows: See attached Exhibit A 1.05 On October 6, 2022, the City Council approved Preliminary Rezoning to PUD, Preliminary Development Site Plan for the apartments and a Subdivision of the subject property. Section 2. FINDINGS 2.01 Approval is based on the following findings: 1. The proposed land uses and density are consistent with the Comprehensive Plan. 2. The proposed plans are consistent with the overall development plan for the site. 3. The proposed restaurant meets the development standards established as part of the PUD Zoning of the site. RESOLUTION NO. 2023-17 Page 2 4. The existing roadways and parking would support the project. SEH conducted a traffic study, which concludes that the proposed project can be supported by the existing roads and proposed new configuration of Arcadia and Eden Avenue, including the round-a-bout. Section 3. APPROVAL NOW THEREFORE, it is hereby resolved by the City Council of the City of Edina, approves the Preliminary Development Site Plan for a restaurant within PUD-24 at 5146 Eden Avenue. Approval is subject to the following conditions: 1. The Final Development Plans must be generally consistent with the Preliminary Development Plans dated January 27, 2023. 2. The Final Landscape Plan must meet all minimum landscaping requirements per Chapter 36 of the Zoning Ordinance. A performance bond, letter-of-credit, or cash deposit must be submitted for one and one-half times the cost amount for completing the required landscaping, screening, or erosion control measures at the time of any building permit. 3. Provision of code compliant bike racks for each use near the building entrances. 4. The Final Lighting Plan must meet all minimum requirements per Section 36-1260 of the City Code. 5. Roof-top mechanical equipment shall be screened per Section 36-1459 of the City Code. 6. Submit a copy of the Minnehaha Creek Watershed District permit. The City may require revisions to the approved plans to meet the district’s requirements. 7. A Developer’s Agreement/Site Improvement Plan Agreement is required at the time of Final Approval. 8. Compliance with the conditions outlined in the director of engineering’s memo dated January 30, 2023. 9. As required as part of the PUD approvals, the building shall be required to meet the City’s sustainability policy. The developer and building shall work with the City’s sustainability coordinator to ensure compliance. 10. Submittal of a construction management plan subject to review and approval of city staff prior to issuance of a building permit. The plan must demonstrate minimal impact to pedestrian and vehicle movement. 11. Hours of construction must be consistent with City Code. 12. Compliance with the conditions outlined in the fire marshal and building official’s memo dated February 3, 2023.
