EASEMENT FOR UTILITIES
THIS INSTRUMENT, Made this lath day of September, 1956 , by and
between John B. Halloran and. Dorothy i1I. Halloran husband
and wife of the County of Hennepin and State of Minnesota,
parties of the first part, and the Village of Edina, a municipal corporation of
the County of Hennepin and State of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in consideration of
ONE AND N01100 (1.00) DOLLARS, to them in hand paid by the said party of the
second part, the receipt whereof is hereby acknowledged, do Grant, Bargain, Sell
and Convey to said party of the second part an Easement for the purposes herein-
after set forth, in and over the following described property situated in the
Village of Edina, County of Hennepin and State of Minnesota, to wit:
Cormencing at the NE corner of Outlot A of Highwood Addition to Edina
Highlands; thence South 50 feet; thence East 150 feet; thence South
254.8 feet to the Northwesterly line of U.S. H,,;hway No. 169 and 212;
thence Northeasterly along said Northwesterly line to the North line
of the SE= of the NW of Section 32,3 Township 117, Range 21; thence
West to beginning, except road.
All that portion of the above described tract of land which is within
a twenty foot Ta-i.de utility easement, the centerline of which begins
at a point on the South line of the NEB of the NTk4 of Section 32,
Township 117N, Range 21W, of the 5th P.14. a distance of 120.10 feet
West of the J.L.M, located at the S.E. corner thereof; thence West
along said South line a distance of 288.2 feet; thence North 1`60 591
West a distance of 304.06 feet to a point of curve to the right, the
delta angle thereof being 360 22t, the tangent distance equals 14590
feet and a radius of 441,45 feet; thence along said curve a distance
of 280.20 feet to the point of reverse curve to the left; thence along
said curve a distance of 31,39 feet to the point of intersection of
the centerline of Dundee Road with the South line of 11irror Lakes
nieadowwood Addition of Edina Highlands, the delta angle of said
reverse curve being 200 06t 32 ", tangent distance equals 231.19 feet
as of record (measured 231.59 feet), the radius equals 1303.93 feet.
It is the intention and agreement of the Parties hereto that the party
of-the second part shall in the construction, or maintenance of said utilities,
replace the surface after any excavation in connection with such construction
or maintenance work, in as nearly as possible the same condition as before
such excavation.
The duration of this easement shall be perpetual.
