SAELECRELECT \ OPENAPPT CERTIFICKIE OF APPROVAL OF SPECIAL LAW.doc RESOLUTION NO. 2023-44 APPROVING MINNESOTA SESSION LAWS FOR 2023, CHAPTER 64, ARTICLE 10, SECTION 17, ALLOWING THE CITY OF EDINA TO REVISE ITS SPENDING PLAN FOR SALES AND USE TAXES AUTHORIZED BY THE VOTERS OF EDINA ON NOVEMBER 8, 2022, FOR IMPROVEMENTS TO BRAEMAR PARK AS IDENTIFIED IN THE BRAEMAR PARK MASTER PLAN WHEREAS, Minnesota Session Laws 2023, Chapter 64, Article I0, Section 17, allows the City of Edina to increase the amount it spends from the proceeds of its local sales and use tax on implementation of the Braemar Park Master Plan from $21.6 million to $53.3 million, if approved by a majority of Edina voters at a general election; and, WHEREAS, the Minnesota Session Laws 2023, Chapter 64, Article 10, Section 17 law is effective upon approval by a majority vote of the City Council and filing a Certificate of Approval with the Minnesota Secretary of State, all in accordance with Minnesota Statutes, Section 645.021, subdivision 2 and 3. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Edina that: I. The Minnesota Session Laws 2023 Chapter 64, Article I0, Section 17 is hereby approved in all aspects. 2. The City Clerk is authorized and directed to file with the Minnesota Secretary of State, a certified copy of this resolution and the appropriate certificate in the form prescribed by the Minnesota State Attorney General. 3. City of Edina staff are authorized and directed to take all actions necessary to implement Minnesota Session Laws 2023, Chapter 64, Article 10, Section 17.
