NEGATIVE DECLARATION ON THE NEED FOR AN ENVIRONMENTAL IMPACT
STATEMENT FOR 7235 FRANCE AVENUE (EAW), AND APPROVAL OF DISTRIBUTION
OF FINDINGS OF FACT AND CONCLUSIONS
BE IT RESOLVED by the City Council of the City of Edina, Minnesota, as follows:
Section I. BACKGROUND AND FINDINGS.
1.01 WHEREAS, the City of Edina is the Responsible Government Unit (RGU) for the
Macy's EAW Project at 7235 France Avenue, herein referred to as the "project"; and,
1.02 WHEREAS, Minnesota Rule 4410.4300 Subp. 32 requires that an Environmental
Assessment Worksheet (EAW) be prepared for the project; and,
1.03 WHEREAS, an EAW has been prepared as part of the state environmental review
process to fulfill the requirements of Minnesota Statutes Chapter 116D, and has been
circulated for review and comment; and,
1.04 WHEREAS, the preparation of the EAW and comments received on the EAW have
generated information adequate to determine whether the proposed project has the
potential for significant environmental impacts; and
1.05 WHEREAS, the Project is expected to comply with all the City of Edina and review
agency standards; and
1.06 WHEREAS, based on the criteria established in Minnesota Rules 4410.1700, the
project does not have the potential for significant environmental effects; and
1.07 WHEREAS, based on the Findings of Fact and Conclusions, the project does not have
the potential for significant environmental impacts.
1.08 On August 15, 2023, the City Council considered the EAW.
Section 2. APPROVAL
NOW, THEREFORE, BE IT RESOLVED by the City Council of City of Edina that the
EAW for the project is adequate and a negative declaration is made on the need for an EIS.
BE IT FURTHER RESOLVED that the Findings of Fact and Conclusions documenting this
decision be distributed as required by Minnesota Rule 4410.1700 Subp. 5.
