Scope of (Plans -- The plans and specifications describe a reservoir and pump station for use on the existing municipal water supply system. This report covers the design of this project insofar as the 'safety and sanitary quality of the water for public consumption may be affected and applies to this project only and not to the entire system or azW other part thereof. 4. ownership - Municipal 5. Location - Southwest corner of West 70th Street and Dublin Road. b. Pumping apparatus - Two water- lubricated vertical turbine pumps each rated at 2,000 gallons per minute against a total head of 225 feet. 7. Storage - � million gallons reinforced concrete reservoir. 8. Compliance With Approved Plans and Specificationss NO CONSTRDCTION SHALL TAEE PLACE ESCLPT IN ACCORDANCE TUH THE APPROVED PLAN AND SPECIFICATIONS. If It is desired to make deviations from the approved plans and specifications, the State Department of Health should be consulted and approval of the changes obtained before construction is started; otherwise, such construction is installed without Proper approval and in addition may create dangers to public health. Expenditures of public funds for unapproved work are held to be illegal. Conclusion The plans and specifications on this Waterworks project comply in general with the requirements of the Minnesota Department of Health and are recommended for approval with the usual reservations as stated on the attached sheet entitled, "Information Relative to Plan Examinations." Huset, Chief Section of Water Supply and General Engineering MINNESOTA DEPARVENT OF HEALTH Division of Environmental Sanitation Information Relative to Plan Examinations The examination and report on plans and specifications for water supply, sewerage, and plumbing systems is made to inform the State Board of Health concerning the sanitary features of projects presented for consideration in accordance with Regulations 200 and 277, respectively, of the State Board of Health. The approval of such plans is given upon the supposition that the survey and other data on which the design is based are correct, and that necessary legal authority has been obtained to construct the project. The responsibility for the design of structural features and the efficiency of equipment must be taken by the engineer or architect who designs the project. Water - supply plans are examined with regard to the location, construction and operational features of the design and maintenance of all parts of the system which may affect the safety and sanitary quality of the water. Examination is based on the standards contained in the Manual of Water Supply Sanitation. Plans of sewerage and waste disposal systems are examined with regard to the features of design which concern the operation and maintenance of sanitary sewers and treatment works; the efficiency of proposed treatment processes, and compliance with stream standards. The examination is based upon the bulletin entitled, "Information on the Preparation and Submission of Plans for Municipal Sewer Systems and Sewage Treatment Works,It and the bulletin, "Small Sewerage Systems." Plans on plumbing systems are examined only insofar as the provisions of the Minnesota Plumbing Code apply. The State Board of Health reserves the right to withdraw its approval of plans if construction of the project is not undertaken within a period of two years. The fact that plans have been approved by the State Board of Health does not necessarily mean that recommendations for alterations or additions may not be offered at some later time when changed conditions or advanced knowledge make improvements necessary. November 14, 1958 ADDENDUM NO. 2 4 MILLION GALLON RESERVOIR EDINA, MINNESOTA NOV 17 1958 WATERSTOPS AND SEALS That portion of the "SPECIAL PROVISIONS" pertaining to plans pertaining thereto are to be disregarded a4d the tuted therefor: WATERSTOPS MILAN. PIf BlY..:1,011, this item and notes on the following shall be substi- All construction joints throughout the reservoir proper, except the cover slab, shall have 6" Flat Dumbbell Rubber Waterstops, or equal, in place of Labyrinth waterstops and Type 1 waterstops as shown on the structural drawings and as called for in the "SPECIAL PROVISIONS ". These waterstops shall be equal to those manufactured by Servicised Products Corp- oration, Chicago, Illinois. Factory fabricated fittings shall be provided where waterstops intersect, such as at the following points: Between vertical wall joint and horizontal wall joint. Between vertical wall joint and footing. Between footing and slab construction joint. Between slab construction joint and waterstop around columns. The.entire waterstop system shall be mechanically continuous. All joints made in the field shall be made with the use of Servicised Field Splicing Unions and EC 870 Cement, or equal, in accordance with manufacturer °s.instructions or shall be field vulcanized in accordance with the standard practice of the U. S. Corps of Engineers. Waterstops in the horizontal joints in the wall and in the footing at the junction of the wall, shall be fastened in place with wire tied to the re- inforcing steel, or otherwise suitably fastened to allow placing and further to hold it in position during adjoining pours. Holes in the waterstop, for wires, shall be as near bell end of the knob or enlargement of the unit as practical and shall be of the absolute minimum to permit the wire to pass through. COLUMN EXPANSION JOINTS. Expansion joints at columns shall have l "'x 7" premolded, non - extruding, non - toxic, filler in-the joint and shall be sealed to a depth of .1:' at the top. The premolded filler shall be equal to "Kork -Pak" and the sealer shall be a non -toxic material such Addendum No. 2 - 1 as Thiokol type sealer equal to PRC, as manufactured by Products Research Company, or "Vertiseal ", as manufactured by Servicised Products Corporation. The sealer shall be applied in accordance with the manufacturer's recommendation. BOTTOM SLAB CONSTRUCTION JOINTS & VERTICAL WALL JOINTS No sealer will be required in these joints. COVER SLAB CONSTRUCTION JOINTS Exterior joints on the cover slab of the reservoir shall, where shown on the plans, be filled with hot - poured Para - Plastic, as manufactured by Servicised Products Corp - oration, or equal. About 2 months ego our cesspool gave out and we took the matter up with 1r. Min to see if, it were possible to get the sewer eateided,oistward 'from the hose next door and up to the three houses east of ours* so that we might connect to it* Ur. Zikin informed ua recent• ly that he had been unable to do argthing about giving us price on this work because he had not received an O.K. from Mr. Hyde to do so. We would like very much to get this work done immediately before the ground freezes; chin cesspool has been open for two months and we fool it is a waste of money to try to put in a new cesspool when the .sewer should be eaUnded in order to relieve our situation as well as the neighbors to the east of usq who are also having trouble with their cesspools* 2* Another matter on which we understand nothing has been done and no t work started involves the storm sever for the Brookview Heights 2nd Addition* Winter is fast approaching and We would like to cee this work completed be— kill fore winter arrives,$ ; V a understood at • the first council meeting in September that Ur. Arle Smith had submitted an estimate of this work* Since that time ,A,0 we have heard nothing else about the project* Are we going to get this work 0 &; � done in 1956 or do we have, to wait another year and hope for more promi.seeZ 3* When the Lake Edina Addition was platted we were compelled to give the Village of Edina a strip of land on the west side of our property and adjoin - ing Normandale Road measuring 15 feet in width and running the length of our property along Normandale Roads, We were told we had to give this land for road purposes before our plat would be accepted. We were promised a service road along side of our property by the fall of 1955 it,we Would make this donation. After the property was deeded and the plat filed there was nothing done On the survey or engineering of this road until just recently. You were recently informed by Bar. Hyde that the State Highway Department said they will try and get this road in in 1957# however$ there is nothing definite about the work, In talking to Mr. McKubrie of the HigYwray Department he in- forms the writer that one thing that is holding up this work is the fact that Mr. Chapman has not deeded the land on the west side of his property for a service road. FOR N0. 3913 W.48th St. Records show the following: 1. On April 25, 1952, a petition was filed for Sanitary Sewer in W.48th St. between Townes Road and France Avenue. This petition was signed as follows: Harold.R. Rosendahl, for 4001 W. 48th St. Harold R. Rosendahl, for 4005 W. 48th St. R.M. Fleming, for 3909 W.48th St. C'.G. Kronmiller, for 3913 W.48th St. (W.65 Ft. of Lot 18 & E. 10 Ft. of Lot 19) . PUBLIC HEARING ON PETITION WAS HELD ON JULY 14, 1952, with action as follows: "Engineer's Estimate of Cost, for a Sanitary Lateral Sewer in W.48th Street, extending.from a point approximately 90 feet East of Townes Road and running Easterly 190 feet, was $1,416.42 as against 266.5 Assessable Feet, for $5.31 per Assessable Foot. Engineer Mitchell explained that because of topography it is not feasible to extend sewer beyond this point; also, that Mr. Rosendahl, sponsor of sewer petition,.has now received Council's permission to install his own main to serve his properties. A delegation of three persons from Townes Road objected to sewerextension and two requested that their names be with- drawn from petition. There were no speakers in favor of plan. Hawthorne's motion, for abandonment of project, was seconded by Danens and unanimously carried." 2. On July 27, 1953, a petition was filed for Sanitary Sewer in W.48th St. between Townes Road and France Avenue. This petition was signed as follows: George Hardisty, for 4717 Meadow Road Ralph E. Willey, for 3905 W.48th St. R. M. Fleming , for 3909 W. 48th St. PUBLIC HEARING ON PETITION WAS HELD ON SEPTEMBER 14, 1953, and Minutes state the following: "Estimate of Cost was given at 2,824.85, or $4.12 per assessable foot, without replacement of Blgcktop. Mr. Mitchell then explained that one abutting lot could not be served because the sewer will be too shallow; that the people on the North side of the street are connected with other sewer lines; that this leaves only three or four lots to bear the assessment. Mr. Kronmiller, owner of Lot 18, asked to go on record as protesting any assessment because he cannot get sufficient fall to be benefited by the line. There were other objections from the floor, and Child moved for adjournment of Hearing to Monday, September 28, 1953, at 7:30 P.M. Motion seconded by Danens and carried. ON SEPTEMBER 28, 1953: "Mayor Erickson announced Continuation of Public Hearing held September 14, on proposed Sanitary Sewer in 11-48th Street between Townes Road and France Avenue. Manager Mitchell's Estimate of Cost was x$1,544.535 or $11.41 per front foot. Mr. Mitchell explained that this high cost is due to the fact that some of the lots which ordinarily would be served cannot be assessed; the lots on the North side of the street being platted to face East and West; and one lot being too shallow to receive fall from the basement. Mr. Willey, sponsor of petition, asked to go on record as being still in favor of project. Mr. George Hardisty, 4717 Meadow Road, stating that he would have to pay considerable extra charge for connection from the side of his lot, said that if Mr. Kronmiller, 3913 W.48th St. is in favor, he will go along with the project. However, Mr. Kronmiller objected. These neighbors were asked to adjourn and discuss the matter privately; and after this discussion, Mr. Hardisty asked that project be abandoned unless Council can see fit to.spread assessment over at least fl our lots. Child's motion that project be abandoned was seconded by Danens and carried." In connection with the operation of said private water system under said franchise Licensee shall be permitted to charge and collect water service charges for the water service within the area described in Section 1 above or in such other area as may be approved by the Village from time to time at no more than the charges for the same or similar service charged and collected by the 'Village in. the operation of its public water system. Secs tion 3. Said Licensee in accepting the franchise hereby granted covenants and agrees: - (a) TO' construct at its sole cost a well, and to provide pumping equip meat, pressure tank, pump, house, and other equipment necessary to provide the water service here contemplated, which well and equipment, together with the land on which loomed, are hereinafter colleotivWv referred, to as the "well." Said well shall beI constructed on Dots One and Two (1 & 2), Block Eight (8), Brookview Heights First Addition, in accordance with specifications approved by the Village Engineer and now on file with the Clerk of the Village and within thirty days after completion of said well Licensee shall certify to the Village the cost of construction thereof ezolusive of the cost of said pressure tank and the cost of said land, which amount, upon acceptance by the Village' shall be the "Original coat" of the well. (b) To maintain said well free from all liens other than the lien for taxes not yet duep (o) To furnish water service within the area described in Section 1 hereof and to operate and maintain said water system, including said well and all mains _connected thereto, in substantially the same manner and condition as the 'Village shall operate and maintain its public water system. (d) To permit the Village to connect: fire hydrants onto the mains in said area at such places as it deems proper at the cost of the Village and to furnish without cost to the Village water needed for fire protection and for other proper and customary public uses within the area specified in section 1 hereof, 1 1' r Section 4. (a) The Village shall have an option to purchase said we team -Licensee at any time f or an amount equal to the original cost of said Well to 'Licensee, less depreciation thereon equal to four (4) per cent per annum on i cost of the pump and other equipment the pressure tank) purchased by `• the Iieensee, and two (2) per cent per annum on the cost of drilling the well, ,, including therein the cost of.the pipe, from June 1, 1953 to the date of said , option. 1' ?� (b) In the event that Licensee for any reason shall fail to perform, the covenants and agreements contained in Section 3 hereof and if Licensee shall" fail to remedy said default within. ten days after written notice from the i Village specifying the nature of said default, the Village shall have the optionk to purchase said well for the sum of One Hundred Dollars ($100.00). (c) Exercise of said option to purchase shall be evidenced by mailing to Licensee a copy of a resolution adopted by the Council of said Village stat- ing that said option is exercised as of a specified date and by tender to Licensee of the option price provided herein on or before said specified date. ; (d) Iti addition to the option price above specified under either of said options the Village shall buy from the Licensee all unbilled accounts for �. water and all accounts for water .billed and riot mare than sixty . days delinquent. ?, (e) Upon exercise by the Village of either of said options' Licensee !, shall execute and,deliver-,to the Village such conveyances and other instruments as may be necessary or desirable to vest title to said'vell in the Village and thereupon the franchise hereby granted shall terminate* Section 59. Licensee shall be under no obligation to furnish water service to areaa�e of the area specified in Section 1 except for;fire protection as hereinbefore.provided, but the Licensee and the Village may mutually agree to render water service to,areas outside the area speoified in Section 1. The Village .pro. poses to proceed in the usual manner with respect to the installation of the mains by letting a contract after advertising for bids and will assess the entire . cost of the mains against the benefited property owners. In so far as the well is concerned, the Village pro- poses to advertise for bids for the drilling of the well but will include in the advertisement for bids a requirement that the bidder accept payment on the basis of a specified sum per gallon of water produced from this particular well. S. 1949s Ch. 412, and in accord- ance with § 412.321, the Village of Edina is authorized to own and operate a waterworks plant for supplying its own needs and those of private consumers. It also has the authority to make extensions and improvements thereof. Our supreme court has recognized the right of a municipality to specify in its advertisement for bids for the construction of a public utility therein that payment therefor shall be made only out of the net earnings from the public utility to be constructed. In D Davies v. Village of Madelia 205 Mill. 26 the court said at page g s 5 � p g 534 of the Minnesota Report; "The method of financing selected by the council was within its power. Payment out of net earnings has a great many advantages to the village and is not an uncommon method of financing municipal power plants. Williams v. Village of Kenyon, 187 Minn. 161, 244 N. W. 558• The method of payment selected appears to have been chosen according to what the council believed to be for the best interest of the village. It has not been established that it was adopted for the purpose of limiting competition. The means selected were not unreasonable, and the trial court's finding in this respect must be approved." Whether the proposed method of financing is for the best interest of the village, or whether it is for the purpose of limiting competition are questions of fact which are not for the attorney general to answer. We assume, of course, that the proposed advertisement for bids will amply protect the village in the event that water is not found at the contemplated level, or, if water be found, it will be sufficient in quantity and suitable for the pruposes intended. We also assume that the total maximum price to be paid by Dthe village will have a reasonable relationship to the value of the labor and materials furnished by the contractor, the benefits to be received by the village, bearing in mind all the relevant facts which in the peculiar circumstances of the case may be appli- cable,.
