Unfortunately the listing realtor and the seller wars aware of them but chose to cover them rather than inform say prospective buyer* We oarnot count the number of people who have commented that "had our home been in St. Louis Park" their health and safety inspection would have avoided our unfortunate experience. Their Safety Inspector, Mr. Sewell, was kind enough to send a copy of the Inspection regulations and checklist, He reported that the program has been very successful and 99% of the people who were rot in favor of it at the time of enactment now agree it was a very wise step indeed. He reports that not only has it improved homes from within, but elimire.ted eyesores from otherwise lovely neighborhoods. We can see this as an excellent means of keeping homes in the City of Edina in top repair inside and outside as our eomzmunity grows older and homes become deteriorated. We have read and heard of oases similar to ours but until experiencing the trauma of living in a potential death trap have we been motivated to action. Probably the major defect which we encountered and v;hich pro=ts us to ask that such an inspection program be instituted here, was a completely rusted out furnace. The lIinneapolis Gas Company, as well as heating people from whom we got bids, said that there was a strong poasibility we could have been asphyxiat9d. Other things we have found or experienced which are listed under 17 Iradiate Health and Safety Eazards were: 1. Low house power whioh caused a flash fire shortly after v+e moved in. N.S.P. found a defective connection into our horse which knocked out our po3cer and that of a neighbor. There were also defective outlets which they suggested replaoing. 2. Cracked bathroom fixture exposing the element through :which the pourer rums. An adult could be badly shocked or a wet child electrocuted. 3. Leaking plumbing in bathroom and basement. 49 Rotted out oomtertop concealed by sink drain board and dish drainer. 5. Two sections of rdssing shingles on roof w}doh were difficult to see except from a neighbors property. 6. Crumbled out garage floor with holes over 3" deep over which oars wore'ala;ays parked completely concealing them. 7. LOUIS PAR:C O.RDI IANCE CODE BY ADDII11G SECTIO14S 5:2305.01 THROUGH 5:2305.11 THE'CITY OF ST. LOUIS PARK DOES ORDAIII: Section 1. The St. Louis Park Ordinance Code is amended by adding Sections 5:2305.01 through 5:2305.11 as follows: Section 5:2305.01. Certificate of Health and Safety Compliance. When the occupancy or ownership of any building within the City of St. Louis Park changes after October 1, 1972, the present occupant or owner, or any agent designated by the present occupant or owner, shall make application for the certificate of health and safety compliance. This section shall not apply to any lawfully licensed multiple dwelling structure, and shall have no affect upon the provisions of law or other ordinances relating to the issuance of building permits. Section 5:2305.03. Application; Inspection. Application for the certificate of health and safety compliance shall be made upon forms fur- nished by the city and approved by the City Council. Upon receipt of a properly executed application for a certificate of health and safety com- pliance, the city manager shall cause an inspection to be made of the premises to insure that the structure is in compliance with the minimal requirements of the housing code. Such inspection wall be based upon re- quirements of the housing code only and shall not be used to discriminate against any person on the basis of race, color, sex, income level, or any other basis not contained in the housing code. Minimal requirements for purposes of this ordinance means those requireme:'zts or standards which were generally in effect at the date of construction of the building, and the immediate health and safety hazards as enumerated in Section IV of the Implementation Standards, Housing Code Requirements. It does not in- corporate those subsequent standards or requirements of the state build- ing codes which reflect present day standards for nev; construction. It is intended to include any condition constituting an immediate hazard to health and safety, but it is not the purpos;: of inspections under this ordinance to. require all buildings to be upgraded to satisfy the standards in the current codes. The standards which must be satisfied in order to obtain a certificate of health and safety compliance are only those standards set forth in the Implementation Standards, Housing Code :Require- ments, Sections I through VI, dated July 17, 1972, which are incorporated into and made a part of this ordinance by reference. Three copies of-the Implementation Standards, Housing Code Requirements, shall be marked "official copy" and filed with the City Clerk for use and examination by the public. Section 5:2305.05. Issuance of Certificate. If the structure. is in compliance with the minivzl requircments of the housing code, the City :•tanager shall cause a certificate of aealth and safety compliance p be issued to the present occupant or owner, which shall state that the structure has been inspected and is in compliance with the minimal require- ments of the housing code. The present occupant, otmer or any agent designated by the present occupant, or owner shall obtain the certificate of health and safety compliance. Section 5:2305.07. Filing of Certificate by Prospective Occupant or Purchaser. The present occupant or oMier, or any agent designated by the present occupant or owner shill furnish a copy of the certificate of health and safety compliance to the prospective occupant or owner, who shall mile a copy of the certificate with the city. The proposed buyer or renter shall not take occupancy of the d:aeLing unit prior to the filing of the certificate with the city, except that upon the filing of an affida- vit by the present or prospective owner or occupant, or his designated agent, approved by the Director of Protective Inspections, which sets forth the dates by which necessary corrective action shall be talon, the occupancy shall be permitted pending issuance of the certificate of health and safety compli- ance. Section 5:2305.09. Review of the Ordinance. At the end of one year following the effective date of this crdinance the Director of Protect- ive Inspections shall make a comprehensive report to the City Council on the results of this program. During the.year the Council shall be furnished with 1.terim reports on activities under the ordinance. Section 5:2305.11. Fee. The fee for the inspection and certificate of health and safety compliance or a dwelling unit shall be ten dollars. Section 2. Effective Date. This ordinance shall take effect October•l, 1972. IMPLEMENTATION STANDARDS HOUSING CODE REQUIRE:•iE S I. GENERAL POLICIES The Housing Inspectbr will review the dwelling unit as it currently exists. Any past work or condition will be inspected and judged as it exists at the time of-the inspection. Any work in place will be evaluated regardless o= c:ho did the work, when it was done, or whether any permits.or inspections were obtained. All facts determined in the inspection process will be held in confidence and used by the Protective Inspection Department for compliance purposes of the housing and general sanitation ordinances. Housing units may be occupied on a conditional basis where no immediate hazard -to health and safety exists. The existing owner or his authorized agent shall apply for the inspection and certification. No dwelling unit will be held vacant due to needed minor corrections not creating an immediate heath or safety hazard or other built -in deficiencies beyond reasonable correction. Decision as to how needed. correction- of deficiencies are to be achieved is solely between the owner a_nd -the proposed occupant. II. HOUSING CODE REQUIRE" •iE:`ITS, E- NFORCE:� 1ENT, INTERPRETATION STA_-`rRDS The following enforcement standards shall be used to modify Ordinance' L;o. 1153 (Housing Code) for min—L -mum performance standards for existing dwelling units ..;'here requirements of the Housing Code are deemed to be beyond reasonable correction. The performance standards of the Housing Code shall be met except as modified. (a) Ceiling Heights: Any existing habitable room with less than a 7 foot 6 inch ceiling height shall be considered a built - -in deficiency which is beyond reasonable correction. M Superficial Floor Area: Any existing habitable room of less than 90 square feet shall be considered a built -in deficiency and beyond reasonable correction. (c) Natural Light and Ventilation: Any existing habitable room with window area less than 10% of the floor area shall be considered a built -in deficiency beyond reasonable correction but in no case shall the re- quired natural light and ventilation be less than 5/ of the floor area. ' (d) Heating: The heating facility shall be based on design criteria of a degree temperature of 150 above the lowest temperature recorded in the previous 10 years. 700 F. temperature shall apply between 6:30 a.m. and 10:30 P.m.-of each day and other times shall main- tain a minimum of not less than 600 F. (For example, if the outside temperature is below the 15 degrees above the lowest recorded temperature, the minimum temperature shall be 60 degrees. All temperature factors shall be computed on the basis of a twenty • mile per hour wind). III. DEFINITIONS For the purposes of Section 5:2305.01 through 5:2305.11 the following definitions shall be used: 1. Habitable Room: Habitable room shall mean any room meeting the requirements of the Housing Code for sleeping, living, cooking or dining purposes excluding such enclosed places as closets, pantries, bath or toilet rooms, service rooms, connecting corridors, laundries, unfinished attics, foyers, storage spaces, cellars, utility rooms and similar spaces, not used by persons frequently or during extended periods. 2. 'Owner: Any person, firm or corporation who alone, jointly, severally with others shall be�in actual possession of or have charge, care or control of any.dwelling or dwelling unit within the City as owner, employee or agent of the owner or as trustee or guardian of the estate or the person of the title holder and such person shall be bound to comply with the provisions of this Code to the same extent as the owner. -2- 3. person: The word person shall include a corporation, firm, partnership, association, organization and any other group acting as a unit as well as individual. It shall also include an executor, administrator, trustee, receiver or other representative appointed according to law. Whenever the word person is used in any Section of this Code, prescribing a penalty or fine as to partnerships or association the word shall include the officers, agents or members thereof who are responsible for any violation of such Section. 4. Repair: Repair shall mean to restore to a sound acceptable state of operation, serviceability or appearance. Repairs shall be expected to last approximately as long as would the replacement by new items. 5. Replace: Replace shall mean to remove an existing item or portion of a system and to construct or install a new item of similar or new quality as an existing item when new. Replacement ordinarily takes place when repair of the item is impractical. 6. Temporary Housing: Temporary Housing shall mean any tent, trailer or other structure -used.for human shelter which is designed to be transportable and which is not attached to the ground or to another structure, or to any utility-system on the same premises for more than ten consecutive days. IV. IMMEDIATE HEALTH AND SAFETY F_4ZARDS The following are considered immediate hazards to health and safety for human occupancy: 1. Heating systems that are unsafe due to: burned out or rusted out heat exchanges (fire box) ; burned our:, or plugged flues; not being vented; being connected with unsafe gas supplies; or being incapable of adequately heating the living space. 2. Slater heaters that are unsafe due to: burned out or rusted out .beat exchanges (fire box); burned out, rusted out, or _plugged flues; not being vented; being connected with unsafe gas supplies; or lack of temperature and pressure relief valves. -3- . a . •� w • 3. 4. 5. 6. Electrical systems that are unsafe due to: dangerous overloading; damaged or deteriorated equipment; unproperly tapped or spliced wiring; exposed uninsulated wires; distribution systems of extension cords or. other temporary methods; ungrounded systems, ungrounded appliances in contact with earth. Plumbing systems that are unsanitary due to: leaking waste systems fixtures and traps; lack of a water closet; lack of washing and bathing facilities; or cross connection of pure water suFo�ly with fixtures or sewage lines. Structural systems, walls, 'chimneys, ceilings, roofs, foundations, and floor systems, that will not safely carry imposed loads. Refuse, garb ,"e, human waste, decaying vermin or other dead animals, animal waste, other materials rendering it unsanitary for human occupancy, including lack of light and air. 7. Infestation of rats, insects,..and other vermin. V. MINOR HEALTH AND SAFETY STANDARDS Other requirements of the Code are considered minor deficiencies and are permitted to be' completed after occupancy takes place. VI. APPEAL PROCEDURE All action taken by members of the Protective Inspection Department under provisions of this ordinance are.subject to appeal. The first step in the appeal process is to the City Manager and if the problem is not resolved a hearing before the Building Construction Codes Advisory Commission will be scheduled. Late Department ent of Building & Safety PETITION - - Petition to the City of Edina, the Minnesota State Highway Department, the Metropolitan Council, Members of the State Legislature and to the Governor: Gentlemen: In Edina, south access to Highway #100 at Benton Ave. has been cut off, ostensibly because Benton is too close to the Crosstown. However, full access has been con- structed (folded diamond) at 77th Street and Highway #100, which is about 400' closer to I494- This is grossly unfair:to residents near Benton! Along the approximately 25 miles of the "Inner Belt Line" from the river at Ft. Snelling to the river in Brooklyn Center, there will be ;about accesses into the neighborhoods, or better than one per mile. With Benton denied south access to #100, there will be a 2. 5 mile gap between 50th and 70th Street. This will be the longest gap between two -way neighborhood accesses on the entire "Inner Belt Line ", nearly twice as long as in the nearly unpopulated area from 34th Ave. to Post Road. (See supplementary sheet,_ Item 1, a specific list of points of access). This is grossly unfairto residents near Benton! In a time when we are trying to economize on our fuel usage, this denial of south access at Benton, will compel hundreds of people in our area to drive nearly four extra miles every time they need to go south on #100. (See Supplement Item 2). It will be more difficult for the Fire Department and the Police Department to get to our area in an emergency. In case of electric shock, drowning or heart attack, the time for a police car to go two extra miles to render help could make the difference between life and death. (See Supplement Item 3). We respectfully petition the following: -The City of Edina to do all in its power to implement fu1L Highway #100 access at Benton. -The Highway Department to submit new plans for this access, meeting the minimum Metropolitan Council standards, with necessary variances, in the least costly manner. -The Metropolitan Council, mindful of our needs, to speedily approve them. -The Legislature to review the powers granted the Metropolitan Council, putting such restraints on the power of the Council as to prevent such oversight of local needs elsewhere in the future. -The Governor, to be especially careful to appoint as Council members only those who will be mindful of, and responsive to,the needs of both majority and minority interests. We further petition the Highway Department to immediately restore the exit that existed on October 3, 1975, from north -bound #100 to the east portion of Valley View Road, and to install a similar temporary access from the west part of Valley View Road to south bound #100. We understand that they will not meet your standards for permanent construct_ . I-^+- °_U ""'F y"' ­;main it until *HP proper access is built. We have, for some time now, patiently endured bypasses as substandard as this, and will endure this one until the better one is completed. We urgently need these accesses during the months it will take for the better one to be planned, approved and completed. ADDRESS ISIGNkTURE _ SIGNATURE + PETITION SUPPLEMENT B This is a supplement to the petition for' access from Benton to highway #100 south. ITEM 1: A specific list of pointsof access. There apparently will be 6 interchanges that will not be useful accesses into the nearby neighborhoods, because the intersecting highways will be without access to the neighborhoods for some distance. These are: (1) The proposed 494 eastward extension to Mendota Heights. (2) Highway #36 (Cedar Ave. ) (3) Interstate 35W. (4) Henn. Cty. #62, Crosstown. (5) Minn. V. (6) The proposed I94 interchange at West River Road. Even after closing off some small intersections (as has been done in Edina), there will apparently continue to be 29 two -way accesses from the neighborhoods to the "Inner Belt Line"- Highway 55 Normandale Highway 55 Airport Terminal 70th Cty. Rd. 66 Airport Post Road 50th 36th Av. N 34th Ave Excelsior Blvd Highway 52 24th Ave. 36th St. 48th Ave. N Portland /12th Ave. Lake St. Brooklyn Blvd Nicollet 24th St. 57th Av. N Lyndale Cedar Lake Rd Humboldt N. Penn Highway 12 also 77th St. S. France Glenwood Ave. There are only two "half" accesses: Benton and 42nd Ave. N. If this list should prove inaccurate due to the closing of a few of these listed, it still adds up to about one per mile. The Crosstown is not 'valuable as a neighborhood access as you have to drive a mile down the crosstown either way to get off the cross- town. The Valley View Exit off the crosstown is less than a mile but since you cannot turn north immediately, it is no better than going a mile to France Ave. ITEM 2: Nearly four extra miles every time a Benton Area resident wants to go South on #100 and return::home. Residents east of 100 at Benton will go 3/4 mile East to the Valley View entrance to the west -bound crosstown, then a mile to get up on #100 southbound. Coming home they will go two extra miles: a mile of highway driving to France and a mile extra thru neighborhood streets. Total 3. 75 miles waste each trip. The trip home can be reduced to one mile extra by leaving 100 at 70th and threading a long roundabout path through 2. 5 miles of neighborhood streets via the Wyman Ave. Bridge ±tie ^ ^° *^ *'^° R ° ^ *. ^^ Rr;a ;° The Met -^Tolitan Council's denial of south access to #100 at Benton, ostensibly done to reduce traffic hazards, has not reduced traffic hazzards, it has merely "swept them under the rug" by moving them into someone else's jurisdiction. Making the Highway a trifle safer, will make the neighborhood streets more hazardous... and more than a trifle. The Metropolitan Council's decision has actually increased the total hazard. This is not a wise decision! ITEM 3: More difficult for quick fire and police arriv_&L In a life- threatening emergency, it is customary to dispatch the zone car PLUS one or more cars from adjacent zones. If the zone car is at the far corner of the zone, the car from the adjacent /62n %e the first one to arrive (if access is not cut off as it is now). Denial of the south access at Benton, may make this impossible at a critical time, resulting in the tragedy of an unnecessary death. 1W .ZD, - C - :) Mayor James Van Valkenburg City of Edina 4801 West 50th Street Edina, Minnesota 55424 TRAFFIC CONGESTION - LYNMAR LANE/MAVELLE DRIVE This letter is written, Mayor Van a traffic congestion problem that council action. RAMMOUND October 27, 1975 Valkenburg, to acquaint you with has arisen because of previous Stow's Edgemoor and Delaney Additons were developed about 1958 - 1962. Council planning visualized a step down zoning from France Avenue to Lynmar Lane i.e. apartment zoning, double zoning, single residential zoning, with the residential zoning beginning on the west side of Lynmar Lane. To develop the area, the residents of the Stow's Edgemoor and Delaney Addition formed a homeowner's association. Through that association we worked with the village to plan the development of those additons. That cooperation produced some rezoning changes (along France Avenue) to reduce the density problems tua.i, wuulu amvc aribdn w-Lun apartment development only. The cooperative efforts also led to street improve- ment and storm sewer installations. We opted for concrete streets even though the property assessments were higher; this was done as the village officers who met with us (City Manager Warren Hyde and Planning Manager, George Hite) asked us to seriously consider concrete over asphalt as that would materially reduce maintenance costs. We accepted the argument and worked out a plan to assess properties equitably so that the owners of corner lots were not unduly assessed. Until 1972, our additons remained a residential area with walking streets and a usuable park area. With the development of Yorktown, our environmental situation has drastically deteriorated. ENVIRONMENTAL STATUS In 1972, the Edina council approved zoning changes for the Glacier Sand and Gravel properties that led to the Yorktown development. At the time of the hearings, a group of concerned citizens from the Stow's Edgemoor and Delaney additions protested that those zoning changes would adversely affect our residential areas. Our protests did not prevail. We were, however, assured that if traffic problems did materialize, the council would address itself to those problems. Mr. Mayor, those problems have, indeed, materialized. r' -2- JIT - C • -3 A recently completed traffic study (Traffic Safety Committee minutes, October 14) shows that the traffic congestion that we anticipated three years ago has materialized with a resulting deterioration in the environmental surroundings. That deterioration is a result of: a. increased traffic volume b. increased noise pollution c. increased safety hazards d. increased litter The attached map shows the traffic volume; additional flow information is available from Mr. Hoffman's study. The noise pollution accompanies the traffic volume, the constant thumping of tires on the streetjoints. The safety hazards have been lessened by the placement of YIELD signs at Lynmar Lane and Mavelle Drive. The real answer to traffic safety at this street junction, however, is traffic abatement. As you can appreciate, litter attends traffic volume. Soft drink cans, beer cans, and cigarette butts sprinkle our lawns. Finally, we anticipate that this situation, without corrective action, will further deteriorate. The development of the southeast corner of 70th and France (the Southdale National Bank) could dump more traffic into our residential area via Mavelle Drive. Also, it is likely that the Point of France condominiums could also affect the area, Yorktown via Valley View and Lynmar Lane, Hazleton Road rather than France. Many of us have been concerned for some time about the speed of the passing trains. The noise and vibrations definitely are irri- tating but the main point of concern is the safety, and we now have an incident to point to. On Saturday evening, September 15, 1973 there was in fact a derailment of a southbound train just south of West 70th Street. At least one of the cars had jumped-! the track at some point north of Valley Lane. Query: What if the train had derailed somewhere in the vicinity of our homes where the tracks are elevated? Granted, this hasn't happened, rte? But . . . We have been concerned about the lack of regulation of the speed. We now believe that it .is imperative that the speed be reduced in the residential areas of Edina, specifically at the Valley Lane crossing. We suggest a speed of 20, or even 15, miles per hour be set and enforced. In addition, we ask that a guard rail be installed within the existing rail. The property and indeed the lives of some of the residents of Edina are at stake. „ We recognize that such authority does not rest with the. Village of Edina. We do, however, believe that our village has a responsibility to its citizens to petition the State of Minnesota Public Service Commission, a regulatory body that does have such authority. Bredesen, Jr. Mayor of Edina Edina Village Hall Edina, Minnesota Dear Mayor Bredesen: On June 4, a meeting was held at my home, 4912 Payton Court, to discuss the merits of locating the right of way for the Normandale freeway on the east side or the west side of Normandale. No highway or village officials were there, although Mr. Bob Dunn kindly provided a map labeled Layout 16C through Highway 100 from 494 to Benton Avenue, plus an overlay for this map labeled Alternate D' SP 2733 -25 PH 100. 1 had sent postcards announcing the meeting to the 24 families between 66Th and 70th on both sides of Normandale who are affected by the highway location. Eighteen people attended the meeting and after looking at the map and discussing the situation,17 of the 18 indicated they favored placing the right of way on the west side of Normandale. The 18th person was neutral because the access road cut off an identical amount of land from his home regardless of which plan was initiated. The next several evenings I contacted others of the 24 families who were not represented at the meeting, and I asked them if they.wished to sign the petition. In total, I contacted 19 of the 24 affected families and 17 of the 19 signed the petition. There were two families who favored taking right of way on the east side of Normandale. In addition to the above 19 families,l contacted the 5 families on Payton Court who are not adjacent to Normandale. They all signed the petition asking the right of way be on the west side . I decided not to try to contact the remaining five families since I had tried on three occasions and also since Mr. Charles Madden had contacted them a year ago and found most of them were in favor of locating the highway on the west side. Me. Charles Madden, a year ago, got signatures of 21 out of 24 households on a petition to locate the right of way on the west side of Normandale and to expand the access road system on the west side of Normandale in order to open up some new lots in the area between Donens Drive and 66th Street. Page 2 Mayor Arthur C. aredesen, Jr. June 12, 1970 In addition to the fact that an overwhelming majority of the affected property owners prefer the right of way, on the west side, there is another benefit to the State i Highway Commission if the right of way is located on the west side. If the right of way is taken on the east, there are seven houses between 661h Street and Payton Court which will have anywhere from 50 feet to 100 feet lopped off their front yards because of the service road location. No land will be taken from these people if the right of way is located west. Most of these people feel very strongly that taking this amount of land from their lots greatly reduces the value of their property. Several have indicated they will vigorously defend their position, demanding than the highway take all of their land and house if their appraiser's estimate and the highway commission amraiser's estimates differ significantly. Two appraisers have told me it is difficult to come up with a fair evaluation where ,partial "takings" are involved. Thus, it would appear, the State Highway Commission has a "cleaner" situation by taking the right of way on the west side. According to State Highway plans there will be 10 houses taken if the right of way goes on the west side and 8 houses taken if the highway right of way goes on the east side. In addition, . there will be the partial "takings" if the highway goes on the east side.(It is the writer's opinion that the tax base lost to the village is about the some since the houses on the west side are somewhat larger.) Certainly if there is merit in the argument of the first 7 houses south of Normandale on the'east side, that their property values.will be severely lowered if the right of way goes on the east, the tax base loss would appear to be less by taking the right of way on the west side. In summary, I feel the wishes of the people most directly involved should be taken into account by the Council' in making the recommendation to the Highway Commission for which plan is adapted. I heartily recommend, and the preponderance of the affected home owners agree, that the right of way should be taken on the west side of Normandale. Sincerely yours, D.W. Consult with the Minnesota Highway Department to determine how the upgrading of Highway 100 will affect any proposed improvement. 5. Prepare cost estimates. 6. Prepare an engineering report outlining our findings and recom- mendations. We propose to do the work outlined above on a time and materials basis with a not -to- exceed limit of $3,500. Because the soil borings in the lake bed are such an important part of the study and it will be considerably less expensive to take these borings through the ice in the winter, we are proposing to complete this work by January 31, 1970. The vast amount of fill that .went in there has caused me to speculate about possible attempts to derive the greatest speculative profit by attempting to rezone the property for multiple dwellings. When I carried this paper around for signatures, I learned more from- the ,people I visited. Mr. Johnson of 6312 Brookview reported that Mr Lavine had told him of his plans for a multiple dwelling project. Mr. Kerr of 4517 Garrison Lane, reported that his fiend, Mr. Gerald Hansen, had attempted to purchase the property from Mr.._ LkVine who was not interested in selling because it was extremely valuable and he planned to promote a high -rise for that location. These reports give all of us grounds for much concern as we place great value on a single family dwelling neighborhood. , For this reason, I ask that you attach this expression of concern to any other material that you have in your file_ on this property. It is hoped that if a- prospective buyer for this parcel would inquire at your office about the possibility of rezoning it, this concern of the neighbors would be remembered by your staff and related to the buyer. If you do not have a file on this parcel, it is hoped that you will put a folder in your file at this time. Surely it must happen on occasion that an investor will buy a parcel with the idea of making his investment profitable by getting it rezoned. After he has pail. a large price and spent more for planning, the reluctant neighbors become the villans who cause him to losermoney. Erick Lavine can easily recover his purchase price, all taxes paid, the equipment costs for leveling the fill and erecting the barrier at the entrance, and still have a nice profit while selling or developing it for single family. The fill that has gone in there has cost little or nothing as it was fill that he and other contractors needed to discard. If he and any prospective buyers think only in terms of single family residential and do not hold the property vacant too long, our opposition will cause them no loss. The neighbors also expressed the idea that a permit should be necessary to fill in the water area. In response to this, I checked with the Department of Natural Resources, Division of Waters, Permit Section on November 12, 1974 and Laurie searched the file and found no permit for Erick Lavine or Carlson LaVine Inc. The permit section phone is 296 -4800. This was reported to Don Harnack, regional hydrologist for the DNR at 296 -2959, who reported that he will inspect the site. I also checked with Harold Sand who pointed out that the sign "no dumping" includes more than debris but even fill dirt, and that this is covered under Edina ordinance 1001 Sect 15. The police.arrived shortly. The police could possibly have transported the injured youth to Fairview Southdale in a police vehicle, but the fire department rescue vehicle was expected to arrive momentarily. It was delayed because the men in the rescue vehicle apparently did not know the most direct route to the scene. It is reported that one of the policemen on the scene contacted his dispatcher to find out what was holding up the overdue rescue vehicle. It is further reported that.the dispatecher answered that he had tried to make contact but was unable to get an .answer. The tapes or logs should be checked to see if this was indeed the case. There may have been an important breakdown in communications. It is not the purpose of this letter to imply that the delay made any difference in the final outcome to this particular youth. It seeks instead -to find the cause of this delay, so that procedures can be improved to prevent such delay in the future. when such a delay could possibly make a difference between life and death.... or between greater or lesser property damage in case of a fire. The Edina Public Safety Department has made such a splendid track record, that it does not deserve to have its work and reputation questioned by making this concern known ih the public forum, unless there is some possibility that adequate steps have not been taken to prevent its recurrence. We suggest the following considerations to the Council as valid reasons for reinstating Dovre Drive as a two -way street. 1. Dovre Drive was established as a one -way street for no reason better than that the residents petitioned for it. 2. The Petition upon which Dovre was made a one -way street, set forth three specific reasons why the request should be granted: a. "Our primary concern is for the safety of the many small children in this area." b. "Incoming traffic would be forced north and south on Parkwood Lane." C. "It would discourage drive - through traffic." 3. In 1975, when there were no houses on this portion of Parkwood Lane, the Petition probably had It should now go without saying, however, children of Parkwood Lane deserve as much those of Dovrer Drive, and it is no longer assuage the concerns of some residents by onto their neighbors' streets. In August 1977, the Councl:1, was presented with a .'.Petition requesting.removal of one-way traffic on Dove Ukive. The matter was referred to the traffic safety co-maittee, which then received a police department report stating that because radar studies in recent days had indi- cated "no speeding problem or'accident problem,!' the one-, way street system should be continued. This is incompre- hensible. Was the police department intending to suggest tA'�'t if there had been speeding or if there had been accidents, one7way status should then have been removed? The fact that a one-way street has not caused speeding or accidents is not a reason for continuing the status quo. 6. The essence of this issue is that Dovre Drive was set up as a one-way street at a time when there were no residents of Parkwood Lane to object, and was continued as d"', one-way street at a time when there were few Parkwood Lane residents to object. None of us, no matter what street we may live on, likes to have more than their fair share of the traffic burden. Valkenburg: This letter pertains to the northeast quadrant of the Crosstown and Highway #100 and the noise level. The Crosstown noise is still with us and is steadily becoming worse. We have complained to County Officials and also to State Representative Mary Forsythe about the noise, and it seems no one has a solution to the problem. In our last conversation with Representative.Forsythe, she mentioned that she thought the City of Edina should be involved in our plea for help, and this is the reason for this appeal. There seems to be no question about the noise level being above the maximum standards set for noise polution. We cannot even think of opening our windows during the summer months as the constant noise becomes almost maddening. A good night's sleep becomes an impossibility. When we were told about the building of the Crosstown, it was emphasized that this road was not to become a part of any freeway system. Highway No. 7 in St. Louis Park has a speed of 40 MPH and.Highway #100, south of 494 is restricted to 45 MPH. It would seem it would be only sensible to reduce the speed on the Crosstown to 45 MPH, an experiment that would be really minimal in cost. This obviously would divert the truck traffic to Freeway 494, except for those involved with servicing the area near the Crosstown itself. Freeway #494 is almost completely bordered by commercial property, so any increased traffic should not have the effect it has on the Crosstown. Other pollution problems seem to be approached with great speed and sincerity, and it is REALLY difficult to understand why no one seems to take our problem seriously. The attached is a list giving the signatures and addresses of the home owners concerned about this problem. Any help the City of Edina can give toward solving this problem would really be appreciated. Gentlemen: We the people,who are living in the huge apartment at 7151 York are beginning to feel that we are mistreated by being subjected to very dangerous street crossings. Crossings that are almost a necessity for us to cross for every day shopping for food and for our general health. Younger people criticize of for being "chairbound ", but who wouldn't be if their life was in danger every time they took a short walk to the store? We don't drive any more so we would like the same priviledges as younger people. A change to go places upon our two well used -up feet, without getting a spell of nerves from trying to dodge cars that merely hesitate at the corner and then swing around the corner - hoping we will speed up to avoid them. We are signing this note,in the hope that the City of Edina will do the right thing for us "Oldies" and give us a stop and go sign on the busiest corner on York Avenue. In your letter of July 29, 1976 you suggested monitoring the lake during the fall rains to better determine the siltation problem. As we know there were no fall rains. Plow that we have had a few spring rains even a quick glance at the lake clearly shows it is being rapidly transformed into a mud hole. Your letter also seemed to contain a certain amount of reservation or "buck passing" when you stated that the Highway Dept had followed the D.N.R. permit. It doesn't seem it should be necessary for the Melody Lake property owners to have the Court expense of determin%ng what governmental body is at fault. It does seem reasonable that the various departments use their combined skills to come up with a solution to the problem. Your letter does indicate a concern which hopefully means you will get the proper wheels in action to correct and prevent further deteriation of Melody Lake. I would like to meet-with you some time the early part of next week to determine what action is going to take place. Petitions were circulated by an interested and concerned party and left in many of the sotres for signatures. The 50th and France Business and Professional Assn. members discussed and voted unaminously today that on street parking should.be reinstated. Therefore, we would like an opportunity to present this and request. Limited parking on France Avenue from 49.2 Street to 51st Street, at least until all construction is completed and traffic signals are installed at both 4921 Streetand 51 Street. At that time, we would li.ke.the opportunity to meet with you and discuss the future parking regulations to be set forth. Would you please put this matter on the agenda for the February 7, 1977, Edina City Council meeting? We would appreciate your consideration in this matter. U , L' Sincerely, We, the residents of the Parkwood Knolls 17th Addition, would like to strongly reccommend to the Council that the section of Dovre Drive from Parkwood Lane to Biscayne Blvd. be made a one way street flowing westward. As the residents who would be directly affected by this "Western Exit" route unto Parkwood Knolls our reasons for proposing a partial one way are the following: A. Children's Safety - Our primary concern is for the safety of the many small children in this area. Because of the sharp incline going from west to east on Dovre Drive, a driver's visibility is greatly restricted upon reaching the top of the hill. This limited visibility together with the speed needed for the grade causes great anxiety in the parent's minds. We are in agreement that by controlling the eastward flow of traffic this danger would be reduced. B. To Create Multiple Access - As residents of the Parkwood Knolls development we concur that new access is needed.. to and from the area, but that we do not want to create a problem similar to the overloading of the eastern access, i.e. Viewlane /Schaefer Drive. Thus, by creating a partial one way on Dovre, incoming traffic would be forced north and south on Parkwood Lane. Consequently while Dovre Drive and Biscayne Blvd. would carry the westbound traffic, the remaining streets would be used for eastbound incoming traffic. C. To Discourage Drive Through Traffic Patterns - We feel by, initiating this partial one way the resulting routes would aid in discouraging "drive through" traffic, which is a major worry to each resident. D. Control Speed - The addition of stop signs at the intersection of Dovre and Parkwood Lane would help control the speed through out the entire western access, thus, protecting children, property and the intended nature of the neighborhood.
