St. Edina, Minnesota 55424 Dear Mr. Roffman:. i called last week (10/23/78) to learn when the work authorised for 54th. street west of Xerxes was scheduled to be done. No one in your office knew anything about it and said -they would have you -call me. Receiving no call, I decided to attempt contact-by mail. The work in ,mind has to do with the problem) described to the Edina City Council in mfr letter of-August 17, 1978. (Copy enclosed) X have been advised that the Council acted favorably upon my request and authorized oiling, Seal- ing, , and sanding. It is of little importance- to use as to just what process is used to address the problem; but it does concern me greatly that whatever is done angers satisfactorily -to the problem namely, dust control. I do not grant to go into another "patio Season" with the problem.uncorrected. As my letter to the Council explains, we are not"ci.tizens of Edina and, . therefore, have no recourse to "petiti.ont4 in the usual sense of. that word. However, we are citizens of Minneapolis and Minnesota and as such are entitled to the rights and benefits of "clean air" legislation. Minneapolis Minn. 55410 2 R1 Date �0 9 PETITION FOR OILING TO THE HONORABLE COUNCIL OF THE CITY OF EDINA: The undersigned being owners of not less than 51% in frontage of the real property abutting on the following streets in said City: i/ A AAA . between let. and Netween and do hereby petition that said portion of said streets be improved by OILING and teat the cost of said improvement be assessed against abutting property, as authorized by Chapter 395, Laws of Minnesota 1953, as amended. An improvement designated as OILING constitutes only the laying of a dust coat of oil. It does not include the grading or graveling of the street. It is not guaranteed for any particular period of time. In order to expedite the work, no public hearing on the proposed cost is held before the work is done. (Oiling Costs have averaged 34q, per front foot of assessable.property. Costs for all Oiling in any year will be lumped together, and all oiling jobs will be assessed the same amount - Total Cost divided by Total Assessable Feet.) OILED SURFACES DEVELOP CHUCK HOLES. TO ASSIST THE RESIDENTS, THE CITY WILL REPAIR A FEW SCATTERED CHUCK HOLES DURING THE YEAR IN WHICH THE OIL IS APPLIED. THE FOLLOWING YEAR, IF AN OILED STREET BECOMES FILLED WITH CHUCK HOLES AND IT BECOMES UNECONOMICAL TO MAINTAIN, TEE STREET WILL BE SACRIFIED WITHOUT ANY NOTICE BEING GIVEN TO THE OWNERS. THE OWNERS MUST AGAIN PETITION IF THEY DESIRE THE STREET REOILED.
