Clerk read Affidavit of-Publication of Notice of Assessment Hearing in Hennepin County Review, September 30, which was then placed on file. Assessment Roll, in amount of $2,866.36 for Curb and Gutter construction, plus $222.80 for sidewalk construction in -two cases-, was presented and was examined by a delegation of four property oYmers led by Mr. R. L. Batter. A $100..00. error in addition on Mr. Katter's assessment was noted and corrected. The delegation complimented the Council for the fine work done on Thielen Avenue, stating that they were more than satisfied with the results, and inviting Council to make inspection of the newly improved street. There were no objections filed with clerk, either oral or written. Motion seconded by Palen and carried. Mrs. E. M. Bo_rgen presented statement of Harris Bros. Plumbing Co. in amount of $133.11, for connecting and laying pipe from curb line to center of street, from Water Main Improvement No. 4 to 5332 Halifax Avenue Soiath. Mrs: Borgen told_ Council that property had been assessed for curb line service, but had not received it from Village. Mrs. Borgen was asked to sign Verified Claim Form for this bill, and matter was referred. to the engineering department for checking. Application was made for permit to build 70tx801 building for use as public garage on the William Self and Eric Bjorkman properties on the North side of Market Street. Applicants were informed that.they must provide their own parking facilities. Motion by Hawthorne that permit be granted subject to presentation of blue prints and subject to letter from owners of property guaranteeing against the operation of a public nuisance by prohibiting noise of operations between 6 :00 P.M. and 7`:00 A.M., was seconded by Child and carried. Mr. Lewis Jones reminded Council that temporary structure at Van Buren and Maloney Avenues, used for polling place, would be cold for election officials unless some work was done before the General Election of November 2. Mr. Jones was informed that Council expects to have storm sheds built, walls insulated, floors covered, and circulating oil burners installed in both temporary structures. Mr. Jonest reminder that no toilet facilities were available to election official.s,,except those of a neighbor at 415 Vapa Buren, caused Council to direct office to make arrangements with this neighbor.for some small compensation for facilities provided. Petition dated October 7, 1-948, for construction of water main in Abbott Avenue, between W. 56th and W. 57th Street was presented. Motion by Child, setting Public Hearing on Petition for October 25, 1948, at 8:00 P.M., was seconded Hawthorne; carried. fir's � 10.Al /48 Mr. J. B. Berkvam's letter of. October 1, requesting street light standards on Juanity Avenue,. was read. _ Office- instructed ,to inform Mr. Berl-v= by letter that, since installation -of Ornpmental Street Lights is assessed against abutting property owners, Council will act only on petition by owners of 54 of property abutting proposed improvement. _ Dr. Mary Galligau's request for permission to rent parking space in front of her office on W. 50th.Street, was reported. Office asked to inform Dr. Galligan that Council does not wish to establish precedent by such action. In discussion resulting from above request, office was asked to instruct Police Department to notify taxicab operators to have cabs stay definitely vntham in Cab Stand boundaries or they will be tagged. I Mrs. P=1 J -. Schmittis letter of October 5, 1948, requesting relief for Golf Terrace residents from dust blowing from Lakeview Drive, was read. Office asked to inform Mrs. Schmitt that petition for blacktopping is necessary before action will be taken by Council. Hr.-Reuben L. Anderson's request for the grading of Lakeview Drive was read. Office asked to notify Mr. Anderson that blading will be done this fall. Fire Chief Mitzel reported that Villages of Richfield and St.Louis Park are willing to enter into "Emergency Reciprocal Service Agreements° with Edina;, with the under- standing that such services are to be at the'cali of-the Fire - Departments only, ancl that no payment is to be made for them. Hawthorne moved that Village_Attorney be directed to prepare Reciprocal Service Contracts',for wl* ever communities may be involved, such contract to provide that each respective community shall adequately insure its own men and equipment while outside the community; and that Village Attorney shall consult Fire Department with regard to this contract before its final draft. Motion seconded_by Palen and carried. Review was made of Fire Underwriters Inspection Bureau letter of September 25, 1948, and telephone report of October 3.1, in answer to Clerkks inquiry as to insurance rate changes providing Minneapolis Fire Protection Contract is cancelledf the latter report advising against such contract cancellation until additional fire station is congtructed nearer to the business district. After considerable discussion; during which the basing of one fire truck iu business district was advocated, to comply with Fire Underwriters standards, Council took follotring action: 1. Hawthorne moved that tiinneapolis Fire Proteotion Contract be allowed to expire as-of October 28, 1948, and that bond guarantying payment to Minneapolis for fire service claims, and insurance policies covering Minneapolis equipment and men be eeucelled as of that date. -Motion veconded by Palen and unanimously carried. 2. Hawthorne moved that International Fire Truck be based in the garage at the Edina Mixaiciparl. Liquor Store as' ex as possible. Seconded by Palen and carried. Mr. Nitzel recommended that residents be required to obtain permits before'burning lots and fields, in order to lessen grassfires. fir. Mitzel was asked to check with neighboring communities to see what ordinances they have in force. Because Basements had not been secured, nor permission received from St.Louis Park for drainage of storm water from proposed 44th Street Storm Sewer onto St.Louis Park property, the matter of awarding contract for construction of storm sewer was deferred to the-next mseting. Report was made of Park Boards s decision to forego acquisition of Z7orth' 60 ft. of 5..130 ft. of E. 57 ft. of Lot 2, Block 5, Woodbury Park Near Lake Harriet'because• this property has'no public access. County,`Minnesdta, a list_ of landa In said village which became the property_of the State of Minnesota under the pro - visions of law declaring the forfeiture of lauds to the State for non- payment of taxes, which said list has been designated as List 286,0- 1948, and 1 10/11 /48 WHEREAS, each parcel.of land described in said list has heretofore been classified by the Board of County Commissioners of Hennepin County, Minnesota -as non - conservation land and the sale thereof has heretofore been authorized by said Board of.County Commissioners; - NOW THEEWORE,_ be it resolved by said Village Council, acting pursuant to Minnesota Statutes for 1945, Section 282.01, that the classification by said, Board of County"Commissioners of each parcel of land described in said list as non - conservation land be and the same is hereby approved and that the sale of each such'pareel ~of land be and the same is hereby approved.
